FACTS:

The petitioner, a licensed recruiter for overseas employment, appealed from a decision of the Philippine Overseas Employment Administration (POEA) to the National Labor Relations Commission (NLRC). The NLRC dismissed the appeal for failure to post the required appeal bond, citing the Labor Code and the Rules of Procedure of the NLRC. The petitioner argued that the appeal bond was not necessary for licensed recruiters because they are already required to post cash and surety bonds under the POEA Rules. RULING:

  1. The appeal bond requirement applies to decisions of the POEA. The POEA Rules clearly state that in addition to the cash and surety bonds and the escrow money, an appeal bond equivalent to the monetary award is required to perfect an appeal from a decision of the POEA. The appeal bond is intended to further ensure the payment of the monetary award if it is affirmed on appeal.

The standby guarantees provided by the bonds and the escrow money would be depleted if the monetary award were enforced against them, making them inadequate for other obligations the recruiter may incur. The distinction in requirements between overseas recruiters and local employers is justified due to the special risks faced by overseas workers and the solidary liability of overseas recruiters with foreign employers.

  3. The court held that every part of a statute or set of rules should be given effect, and apparently inconsistent provisions should be reconciled whenever possible. Therefore, in addition to the obligations prescribed in the POEA Rules and the escrow agreement, posting the appeal bond is necessary to perfect an appeal from a decision of the POEA.
