ANONYMOUS v. MA. VICTORIA P. RADAM

FACTS:

In an anonymous letter-complaint, respondent Ma. Victoria Radam, a utility worker in the Regional Trial Court of Alaminos City, was accused of immorality for getting pregnant and giving birth while unmarried. Judge Abella conducted an investigation and found that respondent admitted to being unmarried, giving birth to a baby boy, and having a pending application to migrate to Canada with the child's father. It was also revealed that respondent had two other children conceived and born while she was working abroad. Based on these findings, Judge Abella recommended that respondent be found guilty of disgraceful and immoral conduct and be suspended or fined. The Office of the Court Administrator (OCA) concurred with the recommendation to find respondent guilty of conduct unbecoming a court employee but absolved her of immorality charges. The OCA proposed a fine for stating the father as "unknown" on the birth certificate. However, the court found that giving birth out of wedlock is not per se immoral under civil service laws and disagreed with the OCA's recommendation to hold respondent liable for conduct unbecoming a court employee.
