FACTS:

The petitioner, Dr. Mary Jean P. Loreche-Amit, started working as an Associate Pathologist at Cagayan De Oro Medical Center, Inc. (CDMC) in May 1996. After the death of Dr. Jose N. Gaerlan, petitioner was appointed as Chief Pathologist by CDMC's Board of Directors for five years or until May 15, 2011. However, on June 13, 2007, CDMC's Board of Directors recalled petitioner's appointment, which prompted her to file a complaint for illegal dismissal. She alleged that the recall of her appointment was due to her refusal to help Dr. Hernando Emano's daughter become a pathologist. On the other hand, respondents, including Dr. Emano and Dr. Francisco Oh, argued that petitioner was not hired directly by them and also worked as a pathologist in other hospitals.

Both the Labor Arbiter and the NLRC dismissed the complaint for lack of jurisdiction. The Court of Appeals (CA) affirmed the decision of the NLRC, and the petitioner filed a petition for review on certiorari before the Supreme Court. The central issue in the case is whether the labor tribunals have jurisdiction over the petitioner's complaint for illegal dismissal.
