[ REPUBLIC ACT NO. 6535, July 22, 1972 ]
AN ACT GRANTING JOSE ROJAS A FRANCHISE FOR AN ELECTRIC LIGHT, HEAT AND POWER SYSTEM IN THE MUNICIPALITY OF MARIVELES, PROVINCE OF BATAAN.
Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled:
SECTION 1. Subject to the provisions of the Constitution and to the terms and conditions established in Act Numbered Thirty-six hundred thirty-six, as amended and by Commonwealth Act Numbered One hundred forty-six, as amended, there is granted to Jose Rojas, for a period of twenty-five years from the approval of this Act, the right, privilege and authority to install, maintain and operate an electric light, heat and power system for the purpose of generating and distributing electric light, heat and or power for sale in the Municipality of Mariveles, Province of Bataan.
SEC. 2. If the grantee shall not commence the operation of his plant within three years from the date of the approval of this Act, unless prevented by an act of God or force majeure martial law, riot, civil commotion, usurpation by military power or any other cause beyond the grantee's control, this franchise shall become null and void.
SEC. 3. In the event that the grantee shall purchase and secure from the National Power Corporation electric heat and power, the National Power Corporation is hereby authorized to negotiate and transact for the benefit and in behalf of the public consumers with reference to rates.
SEC. 4. It is expressly provided that, in the event the Government should desire to maintain and operate for itself the system and enterprise herein authorized, the grantee shall surrender his franchise and will turn over to the Government all serviceable equipment, therein, at cost, less reasonable depreciation.
SEC. 5. In consideration of this franchise, the grantee shall pay a tax equivalent to five percent of his gross income.
SEC. 6. The franchise herein granted shall be inoperative in the town of Mariveles and other areas being served by the present franchise holder, Mariveles Electric Company, Inc.
SEC. 7. The grantee shall not lease, transfer, grant the usufruct of, sell or assign this franchise, or the rights and privileges acquired thereunder to any person, firm, company, corporation or other commercial or legal entity, nor merge with any other person, firm, company or corporation organized for the same purpose without the approval of the Congress of the Philippine first had. Any corporation to which this franchise may be sold, transferred, or assigned, shall be subject to the corporation laws of the Philippines now existing or hereafter enacted, and any person, firm, company, corporation or other commercial or legal entity to which this franchise is sold transferred or assigned shall be subject to all conditions, terms, restrictions and limitations of this franchise and completely and to the same extent as if the franchise has been originally granted to the said person, firm, company, corporation or other legal entity.
SEC. 8. This Act shall take effect upon its approval.
