[ Act No. 1374, July 12, 1905 ]
AN ACT AMENDING ACT NUMBERED THREE HUNDRED AND FOURTEEN, ENTITLED "AN ACT AMENDING THE PROVINCIAL GOVERNMENT ACT SO AS TO PROVIDE A MORE SIMPLE METHOD OF PROCEDURE IN CASES OF SUSPENDED MUNICIPAL OFFICIALS AND JUSTICES OF THE PEACE," BY AUTHORIZING PROVINCIAL BOARDS TO REINSTATE IN OFFICE SUSPENDED OFFICIALS IN CASES WHERE REINSTATEMENT IS RECOMMENDED BY THE BOARD TO THE GOVERNOR-GENERAL.
By authority of the United States, be it enacted by the Philippine Commission, that:
SECTION 1. Act Numbered Three hundred and fourteen, entitled "An Act amending the Provincial Government Act so as to provide a more simple method of procedure in cases of suspended municipal officials and justices of the peace,'" is hereby amended as follows:
SEC. 3. This Act shall take effect on its passage.
Enacted, July 12, 1905.
SECTION 1. Act Numbered Three hundred and fourteen, entitled "An Act amending the Provincial Government Act so as to provide a more simple method of procedure in cases of suspended municipal officials and justices of the peace,'" is hereby amended as follows:
- By adding at the end of section one thereof the following: "In cases where the provincial board shall recommend to the Governor-General the reinstatement in office of the suspended official the board shall have power by resolution to reinstate such suspended official pending the determination of the case by the Governor-General."
- By adding at the end of section two thereof the following: "and the provincial board may reinstate such suspended justice pending the action of the Governor-General, in the manner provided by said section for the reinstatement of municipal officials."
SEC. 3. This Act shall take effect on its passage.
