[ PRESIDENTIAL DECREE NO. 1372, May 08, 1978 ]

AMENDMENT TO PRESIDENTIAL DECREE NO. 480 WHICH CREATED THE RADIATION HEALTH OFFICE OF THE DEPARTMENT OF HEALTH.

WHEREAS, radiation has become almost indispensable in medicine, industry, agriculture, research and other fields of activity;

WHEREAS, there is an ever increasing hazard posed by ionizing radiation; and

WHEREAS, additional rules and regulations must be instituted in order to cope with these hazards.

NOW, THEREFORE, I, FERDINAND E. MARCOS, President of the Philippines, by virtue of the powers vested in me by the Constitution, do hereby order and decree:

SECTION 1. Presidential Decree No. 480 creating the radiation Health Office of the Department of Health is hereby amended to include the following additional functions and responsibilities:

  1. Establish basic requirements for non-ionizing and ionizing radiation emitting apparatus as well as installations to conform with the "Basic Standards" laid down by the "Code of Practice" for radiation protection.
  2. Formulate policies which are necessary to effectively upgrade the quality of the practice of radiology in the Philippines which is essential in the primary health care of our people.
  3. Establish and maintain a National Radiation Standard Section commonly known as the "Secondary Standard Dosimetry Laboratory."
  4. Establish, supervise and operate a Bio-Medical Engineering Division.

SEC. 2. To carry out its additional functions and responsibilities, the Radiation Health Office of the Department of Health, aside from its regular budget appropriation shall be appropriated additional funds out of any funds in the National Treasury not otherwise appropriated, the yearly amounts of which shall be determined by the Secretary of Health through the recommendation of the Director of the Radiation Health Office.

The appropriation of additional funds for this purpose shall be made available the year following the effectivity of this Decree.

SEC. 3. Penalty Clause.—In conformity with the Revised Administrative Code, any person or institution who shall violate any of the rules and regulations promulgated by the Radiation Health Office in effectively carrying out its functions, shall pay a fine of P500.00 or shall suffer imprisonment for a period of not exceeding six (6) months or both.

SEC. 4. Repealing Clause.—Any provisions of law, decree, order, rules or regulations inconsistent herewith are hereby repealed, revised or amended accordingly.

SEC. 5. Effectivity Clause.—This Decree shall take effect immediately.
