[ MEMORANDUM CIRCULAR NO. 105, July 23, 2006 ]

ENJOINING ALL GOVERNMENT DEPARTMENTS, AGENCIES AND OFFICES INCLUDING GOVERNMENT-OWNED AND CONTROLLED CORPORATIONS, TO INVITE OBSERVERS FROM THE PRIVATE SECTOR AND THE NON-GOVERNMENT ORGANIZATIONS TO SIT IN ALL STAGES OF THE PROCEEDINGS OF THEIR RESPECTIVE BIDS AND AWARDS COMMITTEE



The government recognizes the vital role of the private sector and non-government organizations (NGOs) in reducing, if not eliminating, graft and corruption in the procurement of goods, services and infrastructure projects through active participation and constructive advocacy.

In line with the governing principles on government procurement as embodied in Section 13 of Republic Act No. 9184 as well as its Implementing Rules and Regulations-A, to enhance transparency and accountability, all government departments, agencies and offices, including government-owned and controlled corporations, are hereby enjoined to invite individuals coming from duly recognized private groups in a sector or discipline relevant to the procurement at hand and non-government organizations including those accredited by the Bishops-Businessmen ™s Conference, to sit in as observers in its Bids and Awards Committees (BAC).

The Government Procurement Policy Board (GPPB) is directed to work out appropriate guidelines to enable all agencies to comply with this Memorandum Circular.

This Memorandum Circular shall take effect immediately.
