[ Act No. 3244, November 28, 1925 ]

AN ACT TO AMEND THE PROVISIONS OF ARTICLES FIVE HUNDRED AND EIGHTEEN AND FIVE HUNDRED AND THIRTY-FOUR OF THE PENAL CODE BY IMPOSING MORE SEVERE PENALTIES IN CERTAIN CASES, AND FOR OTHER PURPOSES

Be it  enacted by the Senate and House of Representatives of the Philippines in Legislature assembled and by the authority of the same:

SECTION  1.  Article  five  hundred and eighteen of  the Penal Code is hereby amended to read as follows:

"Art.  518. Any person guilty  of theft shall suffer:'

"1. The penalty of presidio mayor in its minimum  and medium degrees, if the value of the thing stolen shall exceed fifty thousand pesetas.

"2. The penalty of presidio  correccional in its medium and maximum degrees, if the value of the thing stolen shall exceed six  thousand  two hundred and  fifty pesetas,  but shall not exceed  fifty  thousand pesetas.

"3. The penalty of presidio correccional in  its minimum and medium degrees, if  the value of the thing stolen shall exceed one thousand two hundred  and fifty pesetas,  but shall not exceed six thousand two hundred and fifty pesetas.

"4. The penalty of arresto mayor in its maximum degree to presidio correccional in its minimum degree, if the value of the  thing  stolen shall exceed two hundred  and fifty pesetas, but shall not exceed one thousand two hundred and fifty pesetas.

"5. The  penalty of  arresto mayor to its full extent, if the value of the thing stolen shall exceed twenty-five pesetas, but shall not exceed two hundred  and fifty pesetas.

"6. The  penalty of  arresto mayor in its minimum  and medium degrees, if the  value of the thing  stolen shall not exceed  twenty-five pesetas.

"The penalty  for the theft of cereals, fruits, or firewood not exceeding sixty-five pesetas in value, shall be a fine of not less than three hundred and twenty-five and not more than five hundred pesetas."

SEC. 2. Article five hundred and thirty-four of the Penal Code is hereby  amended to read as follows:

  "Art. 534. Any person who shall defraud another in the substance, quantity, or quality of anything which he shall deliver to the latter by virtue of an obligation to  do so shall suffer :

"1. The penalty of arresto  mayor  in its minimum and medium degrees, if the fraud shall not exceed two hundred  ' and fifty pesetas.

"2. A penalty ranging from arresto mayor  in its medium degree to presidio correccional in its minimum degree, when the fraud  is not less than  two hundred and fifty and not more than six thousand two hundred and fifty pesetas.

"3. The penalty of presidio  correccional in its minimum and medium degrees, when the fraud is not less than six thousand two hundred and fifty pesetas and not more than fifty thousand pesetas.

"4. The penalty of presidio correctional in its maximum degree to presidio mayor in its minimum degree, when the fraud exceeds fifty thousand  pesetas."

SEC. 3. This  Act shall take effect on its approval.
