AN ACT AMENDING SECTIONS EIGHTEEN HUNDRED AND FORTY-FOUR AND TWENTY-SEVEN HUNDRED AND FIFTY-THREE, OF ACT NUMBERED TWENTY-SEVEN HUNDRED AND ELEVEN, KNOWN AS THE ADMINISTRATIVE CODE, AS AMENDED BY ACT NUMBERED THREE THOUSAND AND SEVENTY-SEVEN, AUTHORIZING THE DIRECTOR OF LANDS TO ISSUE LICENSES FOR THE TAKING OF STONE, SAND, GRAVEL, AND EARTH FROM THE BEDS OF SEAS, RIVERS, CREEKS, STREAMS, AND OTHER PUBLIC WATERS, AND PROVIDING THAT THE AMOUNTS COLLECTED FOR LICENSES TO TAKE SAID MATERIALS, SHALL ACCRUE TO THE ROAD AND BRIDGE FUND OF THE PROVINCES CONCERNED, AND PROVIDING PENALTIES FOR ITS VIOLATION.
Be it enacted by the Senate and House of Representatives of the Philippines in Legislature assembled and by the authority of the same:
SECTION 1. Section eighteen hundred and forty-four, paragraph two of Act Numbered Twenty-seven hundred and eleven, known as the Administrative Code, as amended by Act Numbered Three thousand and seventy-seven, is hereby further amended so as to read as follows:

SECTION 1. Section eighteen hundred and forty-four, paragraph two of Act Numbered Twenty-seven hundred and eleven, known as the Administrative Code, as amended by Act Numbered Three thousand and seventy-seven, is hereby further amended so as to read as follows:
"As custodian and administrator of the public lands classified by the Bureau of Forestry as non-timber lands, and of other real property of the Insular Government, the Director of Lands, with the approval of the Department Head, shall have power to regulate the occupation or provisional use thereof, specifying in its regulations what kinds of licenses shall be issued by the Director of Lands, including licenses for the taking of stone, sand, gravel, and earth from lands of the public domain or from the beds of seas, rivers, streams, creeks, and other public waters, where such taking is not otherwise regulated under existing law: Provided, That the amounts which may be collected for licenses to take such materials shall accrue to the road and bridge fund of the province concerned: And provided, further, That for the purposes of this Act, provincial treasurers are designated deputies of the Director of Lands."SEC. 2. Section twenty-seven hundred and fifty-three of Act Numbered Twenty-seven hundred and eleven, known as the Administrative Code, as amended by Act Numbered Three thousand and seventy-seven, is hereby further amended by adding thereto subsection (c) which shall read as follows:
"(c) Any person who for commercial purposes and without proper license takes directly or indirectly stone, gravel, sand, and earth from lands of the public domain or from the beds of seas, rivers, streams, creeks, and other public waters, shall be punished by fine of not more than one hundred pesos or by imprisonment not exceeding thirty-days, or by both fine and imprisonment, in the discretion of the court."SEC. 3. This Act shall take effect upon its approval.
