[ REPUBLIC ACT NO. 3471, June 16, 1962 ]
AN ACT PRESCRIBING THE NATIONAL POLICY ON THE CONSTRUCTION AND INSTALLATION OF IRRIGATION PUMPS ACQUIRED WITH THE ASSISTANCE OF THE GOVERNMENT OF THE UNITED STATES OF AMERICA, AUTHORIZING THE IRRIGATION SERVICE UNIT TO CHARGE FARMER-BENEFICIARIES ONLY THE COST OF PUMPS, ENGINES, ACCESSORIES AND COMPENSATING TAX, AND FOR OTHER PURPOSES.
Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled:
SECTION 1. It is hereby declared to be the policy of the Philippine Government to encourage the installation and proper utilization of more pump irrigation systems in order to bring about the social and economic well-being of the people in the rural areas by making available to them irrigation systems to increase production and elevate their standard of living.
SEC. 2. To implement the policy declared in Section one hereof, the Department of Public Works and Communications is hereby authorized to charge the farmer-beneficiaries of irrigation systems only the landed cost of the pump, engines and accessories and the compensating tax due thereon.
SEC. 3. All amounts paid by the farmers to the National Government on account of irrigation systems already installed at the time of the approval of this Act shall be applied to the payment of pumps, engines, accessories and compensating tax due thereon: Provided, however, That any amount paid in excess of the reassigned cost as a result of the implementation of this Act shall be refunded.
SEC. 4. This Act shall apply only to irrigation systems constructed and installed by the Philippine Government with the assistance of the Government of the United States of America. New contracts of purchase of existing irrigation pump systems based on the reassigned cost pursuant to this Act shall be executed between the Government and the farmer-beneficiaries with sufficient collaterals, in lieu of the contracts of purchase now existing between them.
SEC. 5. The Department of Public Works and Communications, through the Irrigation Service Unit, shall implement the provisions of this Act.
SEC. 6. All laws, executive orders, rules and regulations or portions thereof inconsistent with the provisions of this Act are hereby repealed.
SEC. 7. This Act shall take effect upon its approval.
