[ REPUBLIC ACT NO 3958, June 18, 1964 ]
AN ACT GRANTING JOSE DE LEON ELECTRIC PLANT A FRANCHISE FOR AN ELECTRIC LIGHT, HEAT AND POWER SYSTEM IN THE MUNICIPALITY OF SAN MIGUEL, PROVINCE OF BULACAN.
Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled:
SECTION 1. Subject to the terms and conditions established in Act Numbered Thirty-six hundred and thirty-six, as amended by Commonwealth Act Numbered One hundred and thirty-two, and to the provisions of the Constitution, there is granted to Jose de Leon Electric Plant, for a period of fifty years from the approval of this Act, the right, privilege and authority to construct, maintain and operate an electric light, heat and/or power system for the purpose of generating and distributing electric light, heat and/or power for sale within the Municipality of San Miguel, Province of Bulacan.
SEC. 2. In he event that the grantee shall purchase and secure from the National Power Corporation electric energy and power, the National Power Corporation is hereby authorized to negotiate and transact thru the Public Service Commission for the benefit and in behalf of the public consumers with reference to rates.
SEC. 3. The rate for the sale of electric light, heat and power shall always be subject to the regulation of the Public Service Commission.
SEC. 4. It is expressly provided that in the event the Government should desire to maintain and operate for itself the system and enterprise herein authorized, the grantee shall surrender its franchise and will turn over to the Government all serviceable equipment therein, at cost, less reasonable depreciation. It is likewise provided that within two years from approval hereof, the grantee shall extend its service to the barrios of Salacot, Camias, San Agustin, Santa Rita, Salangan, Batasan, and Sibul, all in the Municipality of San Miguel, Province of Bulacan. The Public Service Commission is enjoined to enforce this provision.
SEC. 5, This Act shall take effect upon its approval: Provided, That should the grantee fail to construct and operate its electric light, heat and power system within three years from the approval of this Act, the franchise therefor shall be null and void.
