WHEREAS, the Philippines has acceded to the 1976 International Coffee Agreement (ICA) on October 14, 1980 as an exporting member;

WHEREAS, there is need for a government entity or office to implement the International Coffee Agreement and for the designation of a Certifying Agency and of an Agent of the International Coffee Organization in accordance with the Economic and Control Provisions of the Agreement;

WHEREAS, the government entity or office primarily responsible pursuant to Section 2 of Executive Order No. 574 for the development, promotion, rationalization and regulation of commerce and trade, both domestic and foreign is the Ministry of Trade;

NOW, THEREFORE, I, FERDINAND E. MARCOS, President of the Philippines, by virtue of the powers vested in me by the Constitution, in order to insure proper implementation of the said Agreement, do hereby order:

SECTION I. The Ministry of Trade shall implement the International Coffee Agreement and formulate guidelines therefor.

SECTION II. The Ministry of Trade and the Philippine national Bank are hereby appointed as the Certifying Agency and Agent respectively of the International Coffee Organization, herein, after referred to as Agency and Agent respectively and shall exercise powers and duties as are necessary to carry out the Provisions of this Letter of Instructions and the Coffee Agreement.

SECTION III. The Ministry of Trade is authorized to collect reasonable fees in connection with the implementation of this Letter of Instructions which shall accrue to the General Fund, provided that 50 per centum of such income may be immediately utilized by the Ministry of Trade for payment of international obligations in accordance with the aforementioned Agreement, for maintenance and operating expenditures that the Ministry of Trade may incur in implementing sane Agreement and such other expenses to be incurred in the promotion of coffee exports.

SECTION IV.  In order to enable the Certifying Agency and the Agent to expeditiously carry out its functions, the Central Bank of the Philippines, the Bureau of Plant Industry of the Ministry of Agriculture, the Bureau of Customs of the Ministry of Finance and all other government agencies, bureaus and offices concerned with the processing and approval of export and import documents are hereby directed to make the necessary arrangements with the Ministry of Trade and the Philippine National Bank,

SECTION V. This Instructions takes effect November 1, 1980.
