[ REPUBLIC ACT NO. 7081, July 29, 1991 ]
AN ACT CREATING THE MUNICIPALITY OF TALAINGOD IN THE PROVINCE OF DAVAO
Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled:
SECTION 1. The Barangays of Sto. Nino, Palma Gil and Dagohoy are hereby separated from the Municipality of Kapalong, Province of Davao, and constituted into a distinct and independent municipality to be known as the Municipality of Talaingod.
SEC. 2. The Municipality of Talaingod shall be bounded as follows:
A parcel of land (proposed Municipality of Talaingod) being a portion of the Municipality of Kapalong, Province of Davao, Island of Mindanao, bounded on the South along line 1-2 by the City of Davao, on the West line 3-4 by the Province of Bukidnon, on the Northeast and Southeast along lines 6-7-8-9 to 1 by the mother Municipality of Kapalong.
Beginning at a point marked "1" on plan which is identified as MBM No. 7 cad. 284 Kapalong Cadastre; thence due West 15,700.00 meters to point 2; thence N. 06 deg. 23' E. 10,600.00 meters to point 3; thence N. 06 deg. 23' E. 13,650.00 meters to point 4; thence due East 19,200.00 meters to point 5; thence S. 08 deg. 11' W, 9,644.91 meters to point 6; thence S. 40 deg. 19' E. 4,506.05 meters to point 7; thence S. 17 deg. 26' E. 4,826.62 meters to point 8; thence S. 84 deg. 30' W, 9,189.31 meters to point 9; thence due South 4,940.00 meters to the point of beginning; containing an area of forty-five thousand four hundred ninety-six (45,496) hectares, more or less.
SEC. 3. The seat of government of the new municipality shall be in Tibi-tibi, Barangay Sto. Nino, as aforementioned.
SEC. 4. After-ratification by the majority of the votes cast in a plebiscite to be conducted in the area or areas affected within a period of one hundred eighty (180) days after approval of this Act, the mayor, vice-mayor and other officials of the new Municipality of Talaingod shall be elected in the next regular election of local officials. The new municipality shall be considered duly organized upon the assumption of office of the first set elected local officials.
SEC. 5. The Commission on Elections shall conduct and supervise the plebiscite. The expenses in holding the plebiscite shall be taken out of the Contingent Fund under the current fiscal year appropriations.
SEC. 6. This Act shall take effect upon its publication in at least two (2) newspapers of general circulation.
