AN ACT AMENDING ACT NUMBERED TWO THOUSAND AND FIFTY-FIVE, ENTITLED "AN ACT PROVIDING FOR THE APPOINTMENT OF A THIRD MEMBER OF THE PROVINCIAL BOARD IN THE PROVINCES OF MINDORO, PALAWAN, AND BATANES UNDER CERTAIN CIRCUMSTANCES, PROVIDING THAT IN SAID PROVINCES THE PROVINCIAL TREASURER SHALL BE ACCOUNTABLE FOR ALL PUBLIC PROPERTY, AND TO AMEND ACT NUMBERED ELEVEN HUNDRED AND EIGHTY-NINE BY PROVIDING THAT RESIDENTS OF PROVINCES ORGANIZED UNDER 'THE SPECIAL PROVINCIAL GOVERNMENT ACT' NUMBERED THIRTEEN HUNDRED AND NINETY-SIX, SHALL BE EXEMPT FROM THE PAYMENT OF THE CEDULA TAX," SO AS T6 PROVIDE FOR THE PAYMENT OF A PER DIEM TO THE THIRD MEMBER OF THE PROVINCIAL BOARD.

By authority of the United States, be it enacted by the Philippine Legislature, that:

SECTION 1. Section one of Act Numbered Two thousand and fifty-five, entitled "An Act providing for the appointment of a third member of the provincial board in the Provinces of Mindoro, Palawan, and Batanes under certain circumstances, providing that in said provinces the provincial treasurer shall be accountable for all public property, and to amend Act Numbered Eleven hundred and eighty-nine by providing that residents of provinces organized under 'The Special Provincial Government Act,' Numbered Thirteen hundred and ninety-six, shall be exempt from the payment of the cedula tax," is hereby amended to read as follows:
"SECTION 1. In the Provinces of Mindoro, Palawan, and Batanes when the duties of provincial supervisor are required to be discharged by the provincial governor or the provincial treasurer there shall be a third member of the provincial board who shall be appointed by the Governor-General with the approval of the Commission.

"It shall not be necessary for the third member of the provincial board to reside at the capital of the province or to establish an office in the provincial building, but he shall be required to be present at the sessions of the board and to perform his duties as a member thereof: Provided, however, That by a unanimous resolution of the provincial board, setting forth the grounds upon which it is adopted, and approved by the Governor-General, such third member may, for the time specified in said resolution, be required to perform the duties of provincial treasurer, provincial governor, or any ministerial duty required by the board.

"The third member of the provincial board shall receive a compensation, to be fixed by resolution of the provincial board, of not less than five nor more than fifteen pesos for each day of actual attendance at the sessions of the board. When designated to perform other official duties as above provided, such third member shall be entitled, upon unanimous resolution of the provincial board, to receive for each day that he shall be actually occupied with official duties such compensation as may be fixed in said resolution, not exceeding the maximum compensation hereinbefore prescribed : Provided, That on no one day shall more than one compensation be allowed to such third member. The per diem of the third member, when fixed by the provincial board, shall.not be altered more than once during each fiscal year."
SEC. 2. This Act shall take effect on its passage.
