[ Act No. 2500, February 05, 1915 ]

AN ACT AMENDING SECTION FOUR OF ACT NUMBERED TWO THOUSAND AND FORTY-FIVE, PROVIDING THE MANNER IN WHICH VACANCIES SHALL BE COVERED IN THE OFFICES OF MUNICIPAL PRESIDENT, VICE-PRESIDENT AND COUNCILORS.

By authority of the United States, be it enacted by the Philippine Legislature, that:

SECTION 1. Section four of Act Numbered Two thousand and forty-five is hereby amended by striking out the whole of paragraph three of said section and inserting in lieu thereof the following:
"Whenever a temporary or permanent vacancy shall occur in the office of municipal president, such office shall be filled by the vice-president, if there be one, for the unexpired term and until his successor is elected and qualified.  Whenever a vacancy shall occur in the office of vice-president, such office shall be filled by the councilor who at the last general election received the highest number of votes.  Whenever a vacancy shall occur in the office of councilor, such office shall be covered by the person who shall have received at the last general election the number of votes immediately below that of the votes received by the last of the councilors elected: Provided, however, That if such person should for any reason be disqualified to assume or perform the duties of the office at the time the same is covered, then the person following him in the number of votes at said last general election shall hold said office.  Persons who have started to perform the duties of the offices of municipal vice-president and councilors in accordance with the provisions contained in this section, shall hold such offices during the unexpired time of such offices, or until their successors shall have been duly elected and qualified for the next succeeding term: Provided, further, That in case there are no more persons voted for to cover the place or places vacant, the governor of the province, with the approval of the respective provincial board, may appoint thereto such person or persons as shall have been previously recommended by the respective municipal council."
SEC. 2. The public good requiring the speedy enactment of this bill, the same shall take effect on its passage in accordance with section one of Act Numbered Nineteen hundred and forty-five of the Philippine Legislature.
