GUIDELINES ON THE TRAINING, TESTING, CERTIFICATION AND DEPLOYMENT OF PERFORMING ARTISTS



In line with the state policy of ensuring the development of skills and the careful selection of workers for overseas employment, and pursuant to Resolution No. 1, series of 1993, issued by the Entertainment Industry Advisory Council (EIAC). The following guidelines on the training, testing, certification and deployment of performing artists are hereby issued:


I
Coverage


1.         The issuance shall apply to all performing artists issued for overseas engagement. The term "performing artist" as used herein, means a singer, dancer, musician or self contained performer with or without overseas engagement experience, whether or not covered by an employment contract, and has been determined to be capable of academic and skills training.

2.         The issuance shall apply likewise to all training centers and testing officers. The term "training center" as used herein, means any entity desiring to develop or enhance the knowledge and skills of performing artists, and may include licensed agencies.

Skills Standards


3.         The EIAC, assisted by NMYC, shall develop the skills standards that shall cover the knowledge, skills and attitude requirements of the various performing artists skills.

4.         The skills standard shall be the basis for the testing and certification for the performing artists.

Mandatory Training and Testing for Performing Artists

5.         The training, testing and certification envisioned hereunder shall be mandatory for all performing artists desiring to work overseas. Exemption from training, testing and certification may however be granted to outstanding performing artists under guidelines as may be issued by the EIAC and approved by the Secretary or her authorized representative.

The Training, Testing, Certification and Deployment Process


A.   Pre-Selection of Artists

6.         Performing artists shall apply and submit to any accredited training center the necessary requirements for admission to training.

B.   Training

7.         All performing artists who are admitted for training will undergo training at centers established under such rules and guidelines issued according to this Order, for a period specified in the approved training curricula.

8.         Only NMYC certified trainors can handle training for performing artists.

9.         Only the training curricula that conform to the standards set, shall be submitted for approval by the EIAC and subsequently used in the training for performing artists.

10.       Only accredited training centers established according to the guidelines as may be issued hereafter can conduct training for performing artists.

C.   Artists Testing and Certification

11.       Only the NMYC, through testing officers trained and accredited by it, shall conduct academic and skills (audition) tests on performing artists for purposes of the certification referred to herein.

12.       The NMYC shall train and accredit testing officers (auditioners) in accordance with guidelines issued for the purpose. Such testing officers shall be selected for individuals who are not related directly or indirectly to the deployment of entertainers.

13.       The accredited testing officers shall administer the required tests to evaluate the job readiness of performing artists according to the safeguards developed by the NMYC in consultation with the industry and such other relevant sectors.

14.       The NMYC shall create and organize the necessary administrative structures, and when necessary, accredit and utilize existing performance or testing venues as it may deem appropriate for the effective and efficient implementation of the performing artists certification program.

15.       The NMYC shall prescribe the necessary fees and charges for personal, technical and administrative services of all people and entities who are involved in the implementation of this program.

16.       The NMYC may enter into agreements with other partners and cooperating agencies, groups, or individuals, whom it may deem necessary in the identification, generation, and mobilization of expertise and resources necessary for the effective implementation of the certification program.

17.       The NMYC shall issue a Competency Certificate to performing artists who pass the academic and skills tests.

The Competency Certificate shall be awarded individually to each of the talents. It shall bear among others the name and picture of the talent, his/her code number, his/her picture, his/her signature and the job title for which he/she is certified.

The NMYC shall furnish the EIAC a list of all artists tested indicating the result of the test.

Artists who fail the tests shall be informed by the NMYC immediately.

D.   The Artist Record Book (ARB)

18.       A performing artist who passed the skills and academic tests and was issued the Competency Certificate, shall be issued an Artist Record Book bearing the number of the certificate referred to above.

19.       The POEA shall be responsible for the preparation and issuance of an Artist Record Book to a performing artist whose competency has been certified by the NMYC.

The ARB shall be released by the POEA together with the original Certificate only to the artist. The POEA shall furnish weekly to the NMYC and the EIAC a list of all artists to whom ARB had been issued.

20.       The Artist Record Book shall contain information on the artist's training, academic skills (audition) tests, Competency Certificate Number, and overseas employment history. It shall also indicate the artists personal data and the particular talent he/she possesses.

21.       The Artist Record Book replaces the POEA - issued PECC and ACC cards and the PHILCHIME - issued PPC cards.

22.       The Artist Record Book shall have a three-year validity period and subject to suspension or cancellation by the POEA for violation of the rules and regulations for overseas employment by its holder.

E.  Contract Processing

23.       A duly issued ARB shall be a requirement for contract processing at the POEA.

24.       Individual performing artist shall be covered by individual employment contract. In case of group performers, group booking contracts shall be required by the POEA.

F.  Pre-departure Showcase

25.       Pre-departure showcase preview shall apply only to group performers. Individual performing artists such as singers, musicians and self-contained performers may be processed for deployment upon issuance of the ARB.

26.       The Preview shall ensure that performing artists who have been hired by foreign promoters will be leaving with prepared production numbers. The focus of the Preview will be on the capability of each production company and licensed agency to put together and mount full productions. Thus, the ratings will be on the licensed agency in accordance with a set of criteria. The POEA Tripartite Entertainment Advisory Sub-Committee will act as the Preview Board.

G.   Departure of Artist

28.       In addition to the present requirements, the departing artist will present his/her Artist Book Record to the POEA Labor Assistance Center at the NAIA.

Miscellaneous Provisions


29.       Monitoring of Artists at the Jobsite. The Entertainment Industry Advisory Council, in coordination with the Overseas Labor Office will tap a network of non-governmental organizations (NGO's) at the jobsites for the monitoring of the artists' well being. Foreign promotion agencies and Philippine licensed agencies shall be jointly responsible to take care of the welfare of the artist at the jobsite.

30.       Artist Pooling. The holders of the Artist Record Book shall be entered into the roster of certified performing artists. This pool of artists are priority for overseas deployment.

Full Implementation of the New System


31.       The new system provided herein shall be fully implemented effective 15 April 1994.

32.       The EIAC, with the assistance of its working Committees, will issue the Implementing Guidelines to cover the following areas of concern:
