[ CSC MEMORANDUM CIRCULAR NO. 02, s. 1998, January 22, 1998 ]
AMENDMENT OF SECTION 15, RULE XIV OF THE OMNIBUS RULES, BOOK V OF THE ADMINISTRATIVE CODE OF 1987
Pursuant to CSC Resolution No. 98-0064 dated Jan. 13, 1998, the Commission has amended Section 15, Rule XIV of the Omnibus Rules Implementing Book V of the Administrative Code of 1987 (Executive Order No. 292) by adding a second paragraph thereto, to read as follows:
"SECTION 15. A reprimand whether given by the Civil Service Commission or the head of department or agency shall be considered a penalty. However, a warning or an admonition shall not be considered a penalty.Adopted: 13 Jan. 1998
"The penalty of reprimand does not include any accessory penalty nor entail the forfeiture of leave credits, retirement benefits and bonuses that may be granted."

WHEREAS, section 6, Article IX-A of the 1987 Constitution provides that each Commission en banc may promulgate its own rules concerning pleadings and practice before it or before any of its offices;
WHEREAS, Section 12 (2), Chapter III, Title I (A) Book V of the Administrative Code of 1987 empowers the Civil Service Commission to prescribe, amend and enforce rules and regulations to effectively carry out its mandate:
WHEREAS, Section 12, (15), Chapter 111, Title I (A), Book V of the same Code provides that the Commission shall conduct periodic review of the decisions and actions of offices or officials to whom authority has been delegated by the Commission as well as the conduct of the officials the employees in these offices and apply appropriate sanctions when necessary;
WHEREAS, the existing rules and regulations in the Commission concerning imposable penalties need to be updated and revised to make them more commensurate to the offense committed by the officer or employee concerned;
NOW, THEREFORE, the Commission hereby resolves to amend Section 15, Rule XIV of the Omnibus Rules Implementing Book V of the Administrative Code of 1987 (Executive Order No. 292) by adding a second paragraph thereto, to read as follows;
