[ DENR ADMINISTRATIVE ORDER NO. 52, S. 2004, August 31, 2004 ]
THE REVISED GUIDELINES IN THE ISSUANCE OF CUTTING/HARVESTING PERMITS IN PRIVATE TITLED LANDS
Pursuant to P.D. 705 as amended, and E.O. 192 and in support to the government's agricultural development program within private lands and in order to augment the source of log supply for the wood-based industries, the following amendments to DAO 2000-21 and DAO 1992-16 are hereby issued:
SECTION 1. Definitions - xxx
a) Private Land Timber Permit (PLTP) - is a permit issued to a landowner for the cutting, gathering and utilization of naturally grown trees in private lands, regardless of species.
Special Private Land Timber Permit (SPLTP) shall no longer be issued, as premium hardwood species shall be included in the PLTP.
PLTP may also be issued for the harvesting of naturally grown trees within areas covered by Private Forest Development Agreement (PFDA).
Planted premium hardwood species and all other planted trees shall be covered by DAO 2004-04 which prescribed the guidelines on the utilization and transport of planted trees in private lands.
SEC. 4. The following requirements shall be submitted by applicants for PLTP:
4.1 Duly accomplished application form
4.2 Authenticated copy of the land title/CLOA together with sketch map
4.3 LGU endorsement (any of the Barangay Chairman, Municipal Mayor or Provincial Governor)
4.4 Certification from Local DAR Officer for CLOA areas
4.5 Initial Environmental Examination (IEE)
4.6 Inventory fee based on existing regulations
SEC. 7. Issuing Authority - PLTP shall be issued/approved by the following DENR officials:
SEC. 8. Tenure - The tenure of the PLTP shall be dependent upon the allowable cut granted following the schedule provided below but shall not exceed one (1) year at any time. Provided that only one (1) PLTP shall be issued over the titled property within a period of one (1) year. Provided further, that the extension of the permit may be allowed for a similar period.
The procedure in the application for PLTP is shown in Annex "A"* . All applications shall be filed in the CENR Office concerned.
Repealing Clause - All Sections of DAO 2000-21 pertaining to SPLTP are hereby repealed and other provisions of DAO 2000-21 and DAO 1992-16 not inconsistent herewith shall remain valid and with full force and effect.
Effectivity - This Order shall take effect immediately fifteen (15) days after publication in at least two (2) newspapers of general circulation and submission to the Office of the National Administrative Register.
