REVOCATION OF BUREAU CIRCULARS NOS. 01 AND 02, SERIES OF 1990 AND 2004, RESPECTIVELY
WHEREAS, Section 11 of Administrative Order No. 85-A, series of 1990, dated February 22, 1990, otherwise known as the "Revised Rules and Regulations Governing Accreditation of Medical Clinics and the conduct of Medical Examination of Overseas Workers and Seafarers", provides that the schedule of fees for pre-employment medical examination shall be prescribed by the Bureau of Licensing and Regulation (currently assigned to the Bureau of Health Facilities and Services [BHFS]).
WHEREAS, The Department of Health (DOH), in the exercise of its supervision and control over the BHFS, has the power and authority to amend, revise, modify, repeal or revoke the latter's prescribed schedule of fees.
NOW, THEREFORE, for and in consideration of the foregoing, the Department hereby withdraws, repeals and/or revokes Bureau Circulars Nos. 01 and 02, series of 1990 and 2004, respectively, issued by the BHFS for being contrary to the functions of government regulatory agencies of fixing rates and for not ensuring the quality of pre-employment medical examination of Overseas Filipino Workers.
Hence, all other administrative issuances, bureau circulars, orders, and memoranda related to the aforementioned Bureau Circulars, are hereby withdrawn, repealed and revoked accordingly.
This Order shall take effect upon publication in two (2) newspapers of general circulation.
