[ LTO MEMORANDUM, January 27, 1997 ]
DILAPIDATED/UNSAFE MOTOR VEHICLES
This is a reiteration to my directive issued last January 24, 1997 in Iloilo City during the First Quarter Regional Directors Conference Section 16 of Republic Act 4136 provides:
"If on inspection any motor vehicle is found to be unsightly, unsafe, overloaded, improperly marked or equipped, or otherwise unfit to be operated or not conforming to minimum standards and specifications may refuse to register said motor vehicles, or if already registered, may require the number plates thereof to be surrendered, and upon seventy two hours notice to the owner of the motor vehicle, suspend such registration until the defects are corrected and or the minimum standards and specifications fully complies with"
Pursuant to the Road Safety Program of the Office and in view of the clear provision of the law on the matter, you are hereby directed to refuse registration, suspend if already registered and apprehend if found operating all dilapidated and unsafe motor vehicles in your area of jurisdiction. Send teams to the garage and terminals of public utility operators, inventory their dilapidated and unsafe motor vehicles and advise them in writing to restore their units to full safety status or replace them with newer units, otherwise submit your report to the LTFRB Regional Director in your area and recommend the suspension of the franchises of operators using virtual rolling coffins in public service.
