GUIDELINES FOR SUBSIDY UNDER THE FREE LEGAL AID AND VOLUNTARY ARBITRATION SERVICES PROGRAM




I.

Coverage

The following are qualified to avail of the voluntary arbitration subsidy under the Free Legal Aid and Voluntary Arbitration Services Program:

1.         Individual workers in establishments with no unions or with no collective bargaining agreements; and

2.         Unions which are still in the organizational stage.

II.

Amount of Subsidy

Parties to voluntary arbitration cases submitted under the Free Legal Aid and Voluntary Arbitration Services Program shall be entitled to a subsidy of Five Thousand Pesos (P5,000.00) per case.

III.

Procedure for the Payment of Subsidy

1.         The subsidy shall be granted after a decision is rendered on the case and it shall be disposed of as follows:

1.1     One thousand Pesos (P1,000.00) will be paid to the Office of Legal Aid of the following schools involved in providing representation services through their law students:

a.         Clinical Legal Education and Legal Aid Programs of the College of Law of the Ateneo de Manila University;

b.         Sebastinian Office of Legal Aid of the College of Law of the San Sebastian College; and

c.         Office of Legal Aid of the College of Law of University of the Philippines.

1.2       Five Hundred Pesos (P500.00) will be remitted to the PAVA Regional Chapter to constitute the General Fund for the conduct of promotional activities on voluntary arbitration and training programs for the professionalization of its members.

1.3       Three Thousand Five Hundred Pesos (P3,500.00) will be paid to the voluntary arbitrator as the arbitrator's fee, subject to the following conditions:

a.         In cases which involve monetary awards less than P3,500.00, the Voluntary Arbitrator shall render his services pro bono or a subsidy may be provided, but in no case shall the subsidy be more than the award.

b.         If the Voluntary Arbitrator's fee is equal or a little higher than the subsidy, the arbitrator and the parties to a voluntary arbitration case may agree that the arbitrator's fee be paid in full by the subsidy.

IV.

This Resolution is in addition to TVAAC Resolution No. 2, series of 1997 and supersedes previous Resolutions on the topic.
