[ MTC RESOLUTION NO. 4, S. 2000, May 12, 2000 ]

AMENDING CERTAIN PROVISIONS OF RESOLUTION NO. 10, SERIES OF 1999 ENTITLED œREVISED RULES AND REGULATIONS IMPLEMENTING LOI NO. 1404 ESTABLISHING THE MARITIME TRAINING COUNCIL 



WHEREAS , MTC Resolution No. 10, Series of 1999 entitled œRevised Rules and Regulations Implementing LOI No. 1404 Establishing the Maritime Training Council  was approved on 9 November 1999;

WHEREAS, the said Resolution is one of the national instruments promulgated to give the 1978 STCW Convention, as amended, full and complete effect;

WHEREAS , the said Resolution is one of the principal documents communicated to the IMO Secretary-General in accordance with Regulation I/7 of the STCW, as amended;

WHEREAS , after the Consultative Meeting with the IMO Panel of Competent Persons in Tokyo, Japan on 26-27 April 2000 relative to the information submitted pursuant to Regulation I/7 of the Convention, as amended, it was noted that certain provisions of MTC Resolution No. 10, Series of 1999 need to be revised or amended to conform with the approved institutional framework under Executive Order No. 242;

NOW, THEREFORE, by virtue of Section 2, paragraph 5 of LOI 1404, the Maritime Training Council hereby resolves, as it is hereby RESOLVED to amend the following provisions of MTC Resolution No. 10, Series of 1999:

1.         Article II, Rule 5, numbers 4, 6 and 9 shall read as follows:

4.      Administration - refers to the Maritime Training Council which is the entity mandated to give effect to the Convention as provided for under Section 1 of LOI 1404;

6.      Committee - refers to the Executive Committee created by the Council pursuant to E.O. 242. Series of 2000;

9.      Lead Agency - refers to the agency that coordinates the activities of the different agencies implementing the requirements of the STCW Convention, as amended. It refers to the Maritime Industry Authority pursuant to E.O. 242, Series of 2000.

2.         Article III, Rule 7, number 4 shall read as follows:

4.      Liaise, coordinate and communicate with the concerned government agencies/instrumentalities and private entities, and international organizations particularly the International Maritime Organization, through the Secretary-General, with regards to any supplemental information necessary including subsequent amendments to its rules, regulations and/or procedures relative to the Philippine compliance with or implementation of the Convention;

and as an additional function it shall be:

11.    responsible to other State Parties with respect to the Philippine compliance to the Convention, as amended, including compliance with Regulation I/10.

3.         Article V, Rule 19, number 5 shall read as follows:

5.  Maritime Industry Authority (MARINA)

a.         Act as the lead agency in the implementation of the 1978 STCW Convention, as amended and serve as the central repository of information relative to Regulation I/9 of the Convention;

b.         Issue certificate of dispensation in accordance with Article VIII of the Convention;

c.         Provide the Council with statistics, research studies and other information in the development of trends in the shipping industry, technology and manpower training needs and qualification requirements for Philippine registered vessels.

4.         Article VI, Rule 21 shall read as follows:

RULE 21.            The Executive Committee shall assist the Council in the general formulation of policies with regard to the implementation of the 1978 STCW, as amended. Further, it shall perform other functions as directed by the Council.
