[ SRA CIRCULAR LETTER NO. 9, s. 1993-1994, October 21, 1993 ]

GUIDELINES TO IMPLEMENT SRA SUGAR ORDER NO. 5, DATED OCTOBER 21, 1993



The following guidelines are hereby formulated and published for the information of and compliance by all concerned in the implementation of SRA Sugar Order No. 5, dated October 21, 1993, viz:

SECTION 1.       Storage Penalty (a) As to the original œD  Sugar -  Upon surrender of œD  quedan-permits for withdrawal of the covered sugar thereof, the mill company concerned shall determine the 90-day free storage period reckoned from issuance date of the quedan-permits. If found beyond the 90-day free storage period, the mill company shall charge and collect the penalty of FIFTY CENTAVOS (P0.50) per LKg per day from the last holder of the quedan-permits.

A penalty of FIFTY CENTAVOS (P0.50) per LKg per day shall likewise be imposed and collected from sugar traders/exporters whose œD  sugar for shipment remains unwithdrawn within a period from the date the œD  quedans had been surrendered to the mill companies, the period herein stated is prescribed as follows:

(i)
A 30-day period plus the number of days remaining on the free storage period if œD  quedans were surrendered prior to the date of expiration of its free storage period;
(ii)
A 30-day period if œD  quedans were surrendered on the date of expiration of its free storage period; and
(iii)
A 30-day period less the number of days that transpired after the date of expiration of its free storage period if œD  quedans were surrendered after the free storage period.


(b)    As to the other classes of sugar when swapped against œD  sugar -  upon presentation of œA , œB  or œC  quedan-permits covering such sugar for swapping or exchange, the issuance date shall be transferred to its swapping counterpart. In the event of a subsequent swapping involving the swapped œD  quedan-permit (counterpart œA , œB  or œC ), the original issuance date shall again be transferred to the quedan-permit being swapped and presently to be classified as œD . On withdrawal of this œD  sugar, the procedures in (a), above, shall be applied.

(c)     The mill companies shall make the collection of penalties which shall be payable by check in the name of the Sugar Regulatory Administration (SRA) and shall be handed to the Mill District Regulation Officers assigned in their respective mill districts who shall remit same to SRA at the earliest time possible.

SECTION 2.       Application, Other documents -  Holders of 1993-94 œD  quedan-permits desiring to export sugar to the world market shall apply to the SRA, North Avenue, Diliman, Quezon City, and submit (a) an Application for Shipment of œD  sugar, (b) the Quedan-Permits covering said sugar and Listings thereof, and (c) an Affidavit stating ownership of the sugar, per attachments.

The clearances necessary to withdraw/load the sugar to the vessel will be issued by the SRA.

SECTION 3.*       Further to Section 1(a) and (b), SRA Sugar Order No. 1, dated August 25, 1993, mill companies shall issue to each sugar producer quedan-permits bearing the same serial numbers for each class of sugar. The same is true for consolidated quedan-permits that may be issued.

SECTION 4.*       Invalidation of Quedan-Permits -  Whenever a quedan-permit pertaining to one class of sugar becomes spoiled or improperly prepared and is eventually invalidated prior to its issuance, the quedan-permits for the other classes of sugar, all of which bear the same serial number, shall likewise be invalidated.

SECTION 5.       This Circular Letter shall take effect immediately.
