[ NTC MEMORANDUM CIRCULAR NO. 11-09-2004, September 24, 2004 ]

MANDATORY TAPING OF RADIO AND TELEVISION PROGRAMS



In line with the supervisory, adjudicatory and regulatory functions which the National Telecommunications Commission (NTC) exercises over radio and television broadcasting stations (Act 3846, as amended and E.O. 546), it is hereby directed that the said stations shall tape their respective programs hereunder specified, preserve them for a period of ten (10) days, unless a longer period is required, and make them available to the Commission upon the latter's request/demand to wit:


  1. Talk shows/Live Phone-in Calls e.g. Alas 5:30, Unang Hirit, Mel and Jay, Sharon, Mare-Pare, Morning Girls.

  2. Live Interviews/Public Affairs Programs/Public Service Programs e.g. Magandang Gabi Bayan, Extra Extra, Mission X, Saksi.

  3. News Analysis/Editorials/Commentaries/Documentaries e.g. TV Patrol, Ulat ni Mel Tiangco, Balitang Balita, Teledyaryo.

  4. Magazine Types/Counseling Programs e.g. Probe, Pipol, The Buzz

The following announcement shall be aired after every broadcast of programs described above.

ANNOUNCEMENT

Comments, suggestions or objections to the preceding programs may be referred to the Commissioner, or to the Chief of the Broadcast Services Division (BSD), of the National Telecommunications Commission, at the NTC Bldg., BIR Road, East Triangle, Diliman, Quezon City, or to the Regional Director, NTC Regional Offices, or to the Kapisanan ng mga Brodkasters ng Pilipinas (KBP), and its local chapters.

Any such communications must be received by any of the above-mentioned offices within five (5) days from date of broadcast.

Failure to comply with the above requirement shall warrant the imposition of penalties and sanctions, as follows: for the first offense, penalty of fine in the amount of P5,000.00; for the subsequent offenses: fine and/or suspension/revocation of licenses and permits.

This Circular may be revoked, revised or amended as the Commission deems fit in accordance with law.

This Circular shall take effect after fifteen (15) days from its publication in any newspaper of general circulation and from filing of three (3) certified true copies thereof with the University of the Philippines Law Center and shall modify, amend or supersede any circular, order or memorandum or portions thereof that are inconsistent herewith.
