[ PRC RESOLUTION NO. 448, September 23, 1996 ]
AMENDING PARAGRAPH ONE (1) OF SECTION 14, ART. III OF THE RULES AND REGULATIONS GOVERNING THE REGULATION AND PRACTICE OF PROFESSIONALS , AS AMENDED BY SECTION 2 OF PRC RESOLUTION NO. 332, SERIES OF 1994
WHEREAS, Par. one (1) of Sec. 14, Art. III of the Rules and Regulations Governing the Regulation and Practice of Professionals , as amended by Sec. 2 of PRC Res. No. 332, Series of 1994 provides as follows:
SEC. 14. The questions for inputting into the test bank shall be constructed and personally prepared by the Board Members assigned to the subjects based on their syllabi containing their concepts and topics. However, questions from the academe or any other sources may be adopted and inputted into the test bank after they have been reviewed as to the validity and then modified. Adoption in toto or verbatim of such questions shall not be allowed.
WHEREAS, in a consultation meeting held between the Commission and the Professional Regulatory Boards on September 11, 1996 on the question on whether or not Chairmen and Members of Professional Regulatory Boards should be allowed to ask and/or accept questions from the academe and after considering the arguments for and against, a consensus was reached that, as a matter of policy, Chairmen and Members of Professional Regulatory Boards should not ask/accept questions from the academe;
WHEREAS, the reasons advanced for the adoption of such a policy are: (1) Chairmen and Members of the Professional Regulatory Boards must rely on their competence to prepare their own questions and (2) the practice of allowing the use or adoption of questions coming from the academe motivates or tempts Members of the Professional Regulatory Boards to favor examinees of the schools where the supplier of test questions is connected.
NOW, THEREFORE, the Commission resolved, as it now resolves, to amend Par. one (1) of Sec. 14, Art. III of the Rules and Regulations Governing the Regulation and Practice of Professionals , as amended by Sec. 2 of PRC Res. No. 332, Series of 1994, which shall read as follows:
SEC. 14. The questions which shall be inputted into the test bank shall be personally prepared and constructed by the Board Member assigned to a particular subject. The said questions should be within the contents of the syllabus of the subject. Under no circumstance may a Member of a Professional Regulatory Board be allowed to ask and/or accept questions from the academe; otherwise, said Member of the Board shall be amenable to administrative sanction.
This Resolution shall take effect after fifteen (15) days from its publication in the Official Gazette or in a newspaper of general circulation, whichever is earlier.
