[ LTFRB MEMORANDUM CIRCULAR NO. 2001-008, February 21, 2001 ]
CLARIFICATION ON THE APPLICATION ON MEMORANDUM CIRCULAR NO. 2001-003 (LATE FILING OF PETITION FOR EXTENSION OF VALIDITY)
The Board, in response to numerous motions to allow the late filing of petition for extension of validity, passed last February 1, 2001 Memorandum Circular No. 2001-003 allowing the acceptance and processing of Applications for Extension of Validity whose franchises expired as of January 1, 1996.
The Board has noted, however, that in the implementation of the said circular, there have been applications involving expired franchises whose authorized units have already been dropped and converted to private use. In addition, there have been applicants of franchises covering more than two (2) units.
In allowing the late filing, the Board, in its deliberations, had not intended to include those franchises whose units have already been dropped, nor those certificates of public convenience whose authorized units are more than two (2). The Board, in allowing the late filing, had in mind operators such as the single unit jeepney owners who rely on their units as their main source of income.
Accordingly, for purposes of clarification, applications for late filing of extension of validity whose franchises authorize more than two (2) units shall not be accepted, even if the applicant wishes to extend the validity of only two (2) of the authorized units. In the same token, applications involving units that have been dropped and converted to private use shall not be received and processed.
Memorandum Circular 2001-003 shall be effective only until December 31, 2001.
All other issuances or parts thereof which are inconsistent herewith, are therefore modified or superseded accordingly to conform with this directive.
This circular shall take effect immediately.
