AMENDMENTS TO SUBIC CUSTOMS MEMORANDUM ORDER 3-97



By authority of Section 608 of the Tariff and Customs Code of the Philippines as amended the following amendments to Subic Customs Memorandum Order 3-97 are hereby made:

I.          Paragraph 2.2 of Subic Customs Memorandum Order 3-97 is hereby amended to read as follows:

2.2    This order shall apply to all LECC shipments tendered and brought to the LECC Center of FedEx at its Hub at the SBF.

II.          Paragraph 4.1.6 of Subic Customs Memorandum Order 3-97 is hereby amended to read as follows:

4.1.6 For purposes of this order, LECC shipments for transfer to or for consumption in the Customs territory by FedEx customers shall only be allowed if such customer is a customs bonded warehouse or located in Special Economic Zone as defined in R.A. 7916 provided that the nature and kind of shipment for delivery to FedEx customers hereinabove described shall be limited to the following:
a.            raw materials
b.            equipments
c.            machineries
d.            spare parts
III.         Paragraph 4.1.7 of Subic Customs Memorandum Order 3-97 is hereby amended to read as follows:
4.1.7 Shipments entered in the LECC and applied for withdrawal to the Customs territory other than to Customs Bonded Warehouses and Special Economic Zones as provided for under 4.1.6 above shall be cleared pursuant to CMO 22-95 and subject to the Clean Report of Finding requirement unless exempted under existing orders. Those that will arrive without CRF and not exempted shall be dealt with pursuant to CMO 9-95.
IV.        Paragraph 5.1 of Subic Customs Memorandum Order 3-97 is hereby amended to read as follows:
5.1    LECC shipments defined in paragraph 4.1.6 of this Order shall be stored therein for a maximum period of thirty (30) days. Upon the lapse of such period, the same shall be declared abandoned to be disposed in the manner provided by law. Shipments intended for registered enterprises in the SBF may be stored therein for a period of sixty (60) days. International mail for entry into the Philippines Postal System shall be moved with dispatch.
V.        Effectivity Clause

This Order shall take effect immediately and shall remain in full force and effect until otherwise revoked. Provisions of Subic Customs Memorandum Order No. 3-97 not otherwise amended by this order shall remain in full force and effect.
