[ PPA MEMORANDUM CIRCULAR NO. 52-98, October 30, 1998 ]
DEPARTMENT ORDER NO. 98-1180
Enclosed is a copy of the 09 October 1998 DOTC Order No. 98-1180* on the "Enforcement of Maritime Safety Rules and Regulations". Under said order, the Maritime Industry Authority (MARINA) shall be the policy-making agency on maritime safety while the Philippine Coast Guard (PCG) shall be the implementing and enforcement agency for maritime safety rules and regulations governing the safe operation of Philippine-flag vessels engaged in domestic trade.
In line with the functions deputized by MARINA to PCG, and consistent with the guidelines and documentation process prescribed in PPA AO 03-92 and PPA MC 15-93, which were issued to implement EO 493, the withholding of a vessel's clearance by PDOs/PMOs shall be effected upon receipt of the Inspection Apprehension Report or of an official written Request/Notice from the PCG to hold a vessel for violation of MARINA/PCG regulations.
