DELEGATION OF FUNCTIONS ON ANIMAL FEES AND VETERINARY DRUGS AND PRODUCTS TO THE REGIONAL FIELD UNITS



WHEREAS, the Bureau of Animal Industry (BAI) is mandated to implement the provisions of Republic Act (RA) 1556 or the Livestock and Poultry Feeds Act; RA 3720 and 6675 otherwise known as the Food, Drugs and Devices and Cosmetics Act and the Generics Act of 1988, respectively, through a Joint Memorandum of Undertaking between the Department of Agriculture (DA) and the Department of Health;

WHEREAS, some technical staff of the Regional Field Units (RFUs) were deputized by DA as Regional or Provincial Animal Feed and Veterinary Drug and Product Control Officers (R/PAFVDAPCOs) to assist in the implementation of RA 1556, RA 3720 and RA 6675 in their respective regions and provinces;

WHEREAS, Certificates of Registration, Licenses to Operate, Certificates of Product Registration and Import Permits are issued by the BAI Director;

WHEREAS, Executive Order No. 366 provides for the rationalization of the functions and operations of the agencies of the executive branch that would transform the bureaucracy into an effective and results-oriented institution for the efficient delivery of services;

NOW, THEREFORE, I, ARTHUR C. YAP, Secretary of Agriculture, do hereby issue this Order delegating the following functions to the different RFUs;

1. Application for renewal of registration of all animal feed and veterinary drug and product establishments (manufacturers, traders, importers, indentors, suppliers, wholesalers, distributors, retailers, outlets) and their products shall be approved by the Regional Executive Directors (RED) in their respective regions.

2. Import Permits (IPs) for animal feeds and veterinary drugs shall likewise be issued by the REDs in their respective regions.

3. The deputized R/PAFVDAPCOs shall continue to conduct regular inspection, evaluation, feed sampling and monitoring activities within their respective areas of jurisdiction.

4. All regions shall be required to submit copies of the approved renewal of registration and IPs, monthly Accomplishments, Production, and Importation Reports as well as Laboratory Analysis results to BAI.

5. The REDs shall designate appropriate personnel to perform the delegated functions and BAI shall provide training on the evaluation and processing of the applications for renewal of registration and IPs.

6. The Director of BAI is hereby authorized to issue additional guidelines to ensure the smooth implementation of this Order.

This Order shall take effect upon approval and supersedes all other orders, memos and other issuances which are inconsistent thereof.
