EXTENSION OF MEMORANDUM CIRCULAR NO. AFF-04-019 (14 SEPTEMBER 2004)



Whereas, Memorandum Circular (M.C.) No. AFF-04-019 [14 September 2004], Section 4 provides for a 60-day period for certain classes of aliens to be re-instated to their bona-fide status as lawful non-immigrants in the Philippines;

Whereas, many of the aliens concerned have been unable to re-instate such bona-fide status due to unforeseen adverse business conditions, unexpected economic hardship, or lack of sufficient notice or information;

Whereas, public interest warrants an extension of the 60-day period under M.C. No. AFF-04-019 [14 September 2004], Section 4 to optimize the re-instatement of certain classes of aliens to their bona-fide status as lawful non-immigrants and immigrants in the Philippines;

Whereas, the Commissioner of Immigration is vested with authority to address this concern by prescribing such supplemental procedures as may be necessary under the principle of subordinate legislation;

Now, therefore, pursuant to Commonwealth Act No. 613, Section 3, as amended, and Republic Act No. 562, Section 2, as amended, in relation to Letter of Implementation No. 20 (1972), Section 15.1 (a) and (c) and Executive Order (E.O.) No. 292 (1987), Book III, Title I, Chapter 3, Section 10, this supplemental memorandum circular is hereby issued, to wit:

SECTION 1. Extension of 60-day period to re-instate lawful status - Aliens under M.C. No. AFF-04-019 (14 September 2004) are hereby granted an additional 60 days or until 15 January 2005 within which to re-instate their lawful status as non-immigrants or immigrants in the Philippines.

SECTION 2. Extension of 60-day cease and desist initiative. Administrative disciplinary action. Exceptions - The 60-day cease and desist initiative under M.C. No. AFF- 04-019 (14 September 2004) is likewise extended.  Thus, all officers, officials and employees of this Bureau, whether organic, detailed, contractual or otherwise, shall cease and desist, under pain of administrative/disciplinary action, from conducting operations, proceedings, inquiries and the like, of whatever kind or nature, and/or for whatever purpose, against aliens during this period of extension, unless expressly directed by the Commissioner of Immigration, Secretary of Justice or by the President.

SECTION 3. Effectivity - This memorandum circular shall take effect within five (5) days after its publication in a newspaper of general circulation.
