Terms, Qualifications Requirements, Duties and Responsibilities of Video Exhibitors



Due to several reports from various sectors received by the Board on the rampant showing of unauthorized, pirated, or pornographic videograms by Video Exhibitors, the Board reiterates Memorandum Circulars Nos. 05-87, 13-87 and 08-88 defining, among others, the terms, qualification requirements, duties and responsibilities of Video Exhibitors.

Video Exhibitors (Theater and Non-Theater) - Any person, whether natural or juridical, engaged in the showing of cinematographic art, performance or event in videograms or any technical variation thereof in public places for commercial purposes or in private places for monetary or promotional considerations.

A
Registration and Licensing

  1. Theater Category - All persons engaged in the public exhibition of videograms or any technical variation thereof in public or private places where the showing is for monetary consideration or where fifteen (15) or more persons are accommodated, should first be registered with and licensed by the Videogram Regulatory Board as Exhibitor/Theater Category.
  2. Non-Theater Category - All restaurants, pubs, hotels, motels, airlines, shipping lines and businesses engaged in the act or business of commercial exhibition of any cinematographic art or work, performance, or event using videogram as a medium, for promotional purposes or added feature, shall register with and be licensed by the VRB as Exhibitor/Non-Theater Category.

Registration Fees

There shall be a one-time registration fee of P500.00 per establishment and an annual license fee for each Exhibitor as follows:

1.  Theater Category

Below 300 persons

P750.00 per establishment
 

301 - 700 persons

P1,000.00 per establishment
 

701 or more persons

P1,500.00 per establishment
 

     Seating Capacity

2.  Non-Theater Category

Restaurants, pubs, etc.

P  500.00 per outlet/branch
 

Buses, airplanes, ships etc.

P 100.00 per unit
 

Motels, hotels, etc

P1,000.00 per establishments.

Board Review, Classification and Approval

Only videograms or any technical variation thereof approved and classified by the Board supported by a VRB Commercial Permit for Public Exhibition may be publicly exhibited by video exhibitors.

Duties and Responsibilities

  1. The video exhibitor shall refuse the entry of persons under eighteen (18) years of age when exhibiting videograms classified by the Board as Restricted (R) and of persons under thirteen (13) years of age when exhibiting videograms classified by the Board as Parental Guidance (P).

    At all times, video exhibitors, shall only show videograms with the appropriate ratings to their audiences.

  2. The video exhibitor shall be liable for the exhibition of videograms whose film contents are immoral, indecent, obscene or unjustifiably violent and are not approved or passed upon by the Board.
  3. The presence of unreviewed, unclassified, unlabelled or mislabeled videograms, or videograms which are undubbed or improperly dubbed within the establishment shall constitute prima facie proof of illegal commerce of such videograms.

Inspection

The Board or its duly authorized representatives shall be allowed unhindered entry into the business premises of all Public Exhibitors to inspect videograms or any technical variation thereof and to determine compliance with P.D. 1987, its Implementing Rules and Regulations and Memorandum Circulars.
