INCLUDING ASIAN UTILITY VEHICLE (AUV)/VAN EXPRESS SERVICE AS ADDITIONAL TYPE OF PUBLIC TRANSPORT SERVICE FURTHER AMENDING DEPARTMENT ORDER NO. 97-1097
It has been observed that a new type of service has recently evolved utilizing Asian Utility Vehicles (AUV/Van that are either franchised as megataxi, shuttle service, vehicle for hire, garage service, trucks for hire, taxi and school services or are operating without valid franchises. The operation of the latter is detrimental to the commuting public as they are not afforded ample protection in case of vehicular crashes. It also breeds unfair competition against the authorized operators as well as a considerable loss in fees and revenues in favor of the government.
Department Order No. 97-1097 "Providing Standard Classification for All Public Transport Conveyances" as amended by Department Order Nos. 98-1127; 2002-39 and 2002-75 is further amended to include a new service category to be known as AUV Express Service.
Applications for AUV/Van Express Service shall strictly conform with the following operation specification:
Petition for conversion of franchise by AUV/Van with the above body operating as PUJ aircon, Filcab, Vehicle for Hire, Shuttle Service, school service and Trucks for hire may be considered upon payment of compromise fines and penalties for breach of the terms and conditions of their franchises in the amount of P30,000.00. Said Fee shall be in addition to the regular fees and charges imposed under Department Order No. 2001-82.
All issuances, orders or parts thereof which are inconsistent herewith are modified and/or superseded accordingly.
This Order shall take effect fifteen (15) days following the filing of three (3) copies hereof with the UP Law Center, pursuant to Memorandum Circular No. 11 dated 09 October 1992.

Seating Capacity : Nine (9) including driver including (2 in front, 3 in the middle and 4 at the back) per AUVs. Eleven (11) including driver (3 in front, 2 at the back of the driver, 2 in the middle and 4 at the back) for Vans. Jumpseats are not allowed to seat passengers, therefore, should be removed.
Body Make : Asian Utility Vehicles such as Toyota FX/Revo, Mitsubishi Adventure, Isuzu Crosswind and similar body types and Vans such as Toyota L-300 (non-FB type), KIA Besta/ Pregio, Nissan Urvan and other similar body types Route : Fixed route, subject to approval of the Board : Shall not directly compete with MRT/LRT, PUB and PUJ routes. Maximum 25% direct co-routing with PUB and PUJ routes may be allowed.
: Terminal to terminal with no loading/unloading between origin and destination
Route Distance : 15 kilometers for intra-regional routes 35 kilometers for inter-regional routes Maximum Age : Ten (10) years reckoned from the date of manufacture of unit(s) requirement
Fare : Fare based on distance traveled by a passenger and as authorized by the LTFRB
Ventilation : Air conditioned
