SAFETY INSPECTION OF ANCILLARY SERVICES IN THE ISSUANCE OF PERMIT/CLEARANCE TO OPERATE
1. AUTHORITY
1.1 Article I, Section 5, paragraph D of Dockwork Safety and Health Standards promulgated in 1983, as amended in 1985.
1.2 Section 84 of PPA Admin. Order 13-77, General Port Regulations
2.1 To promote safety in the port.
2.2 To ascertain truck's roadworthiness.
3. PROCEDURES
3.1 The Commercial Services.Staff (CSS) shall ensure that all port users, persons and entities engaged in ancillary services secure clearance from the Safety Staff as a rule prior to the issuance of said permit/clearance.
The following services, however, are exempted from the above requirement, namely: Brokerage/Forwarders (without hauling equipment), Custom Bonded Warehouses, CY-CFS, Insurance, Import/Export, Phone/Postal, Chandling, Shipping Agent, Marine Hauling, Cargo Checking/Surveying, Water Supply, Chartering, Security, Handicraft, and Water Transport Operator.
3 2 Those engaged in Port Ancillary Services shall apply for the renewal of permit one (1) month before the expiration of the previous permit.
3 3 Those who intend to engage in said Port Ancillary Services shall likewise apply for PTO or Clearance as the case maybe.
3 4 The Safety Staff shall:
3 4.1 Evaluate all applications for clearance/permit to operate by conducting inspection/s of applicant's area/equipment vis-a-vis their compliance with the pertinent provisions of the Dockwork Safety and Health Standards and other applicable safety regulations.3 5 For new and old applicants for trucking services they are given one (1) month after the issuance of PTO to make available to the Safety Staff all their truck units for safety inspection/s
3 4 2 Furnish the applicant with a copy of the duly signed inspection report with appropriate recommendation/s.
3 4 3 Submit the report and recommendation/s to the Port Manager, through Commercial Services Staff.
3.6 Pending issuance of the new permits, the previous expired permit shall still be recognized but shall be valid for only thirty (30) days after its expiration.
4.1 As a general rule, inspection shall be conducted inside the port premises.
4.2 The inspection may be conducted however at the premises of the operator upon its request.
Non-compliance with any of the requirements stated in paragraphs 3.1 -3.6 shall, after due process, be ground for cancellation of the Permit to Operate or suspension of operation without prejudice to the filing of appropriate charges.
All PPA-PMO-SH Orders, Circulars and other issuances inconsistent herewith are hereby repealed or amended accordingly.
This Circular shall take effect immediately.
