ENLARGING THE JURISDICTION OF THE BOC-SGS APPEALS COMMITTEE II
OBJECTIVE
To provide a venue for the speedy and expeditious resolution of all complaints/questions against the reports/ findings of the SGS on classification and the applicability, comparability and correctness of published values.
ORGANIZATION
There is hereby created a BOC-SGS Appeals Committee II under the Office of the Commissioner which shall be composed of the following:
1. Deputy Commissioner for Internal Administration Group - Chairman
2. Director. Legal Service, or his representative - Member
3. Deputy Collector for Assessment, POM, or his representative - Member
4. Deputy Collector for Assessment, MICP, or his representative - Member
5. Deputy Collector for Assessment, NAIA, or his representative - Member
6. Representative of the PCCI - Member
7. Representative of the SGS - Member
8. Representative of the Tariff Commission - Member
9. Representative of the Bureau of Import Services - Member
JURISDICTION
The Committee shall have jurisdiction relative to questions/disputes:
1. Arising from SGS classification as reported in the SGS-CRF.
2. On the applicability, comparability and correctness of published values.
POWERS AND DUTIES
The Committee shall exercise the following powers and duties:
1. To meet regularly at least twice a week to study, evaluate and deliberate all complaints against the findings/ reports of the SGS on classification as reflected in the Clean Report of Findings
2. To summon parties for clarificatory questions as the need arises.
3. To resolve immediately all complaints/questions on classification and applicablity, comparability and correctness of published values and submit its findings and recommendations to the Commissioner of Customs for approval.
4. Once approved by the Commissioner of Customs , to transmit its findings and recommendation to the District Collector for implementation.
EFFECTIVITY
This Order which modifies CMO 12-96 shall take effect immediately and shall last until revoked.
