[ LTFRB MEMORANDUM CIRCULAR NO. 2004-032, September 30, 2004 ]
VEHICLES CLASSIFIED AS "VANS" BY THE LAND TRANSPORTATION OFFICE (LTO) NOT ALLOWED UNDER MINI-BUS SERVICE DENOMINATION
It has been reported that the Regional Offices of this Board issued Certificates of Public Convenience (CPC) to Operate a Mini-Bus Service with the use of vehicles classified as "Vans" by the Land Transportation Office (LTO). The issuance of said CPC violated DOTC Department Order No. 97-1097 (Re: Providing Standard Classification for all Public Transport Conveyances), dated 29 September 1997. Pursuant thereto, all vehicles classified as "Vans" by the LTO are not allowed under the Mini-Bus Denomination.
Accordingly, operators affected by this Circular shall be allowed to continue their operations until the expiration of their CPC. Upon expiration, they can extend their CPC, provided, they substitute their vans to units that are in conformity with the standard vehicle classification for Mini-Bus Service Denomination, otherwise, the CPC affected shall be considered abandoned, cancelled and revoked.
All other issuances or parts hereof, which are inconsistent herewith, are therefore modified or superseded accordingly.
This Circular shall take effect fifteen (15) days following the filing of three (3) copies hereof with the UP Law Center, pursuant to Presidential Memorandum Circular No. 11, dated 09 October 1992.
