[ PAB RESOLUTION NO. 02, February 09, 2001 ]

REQUIRING SUBMISSION OF POLLUTION CONTROL OFFICER ™S REPORTS IN PAB CASES



WHEREAS, Section 7 of the Department of Environment and Natural Resources (DENR) Department Administrative Order No. 26 (DAO 26), series of 1992 requires all accredited private Pollution Control Officers (PCOs) to submit a periodic report to the respective DENR Regional Offices every quarter, or as often as may be required, based on the operation and maintenance of pollution source and control facilities concerned;

WHEREAS, item no. (5) of Section 5 (Duties and Responsibilities of An Accredited Pollution Control Officer) of DAO No. 26 categorically states that the PCO shall promptly submit, validated/certified as correct by the General Manager, periodic reports as stipulated in Section 7 therein or as required by the Department (otherwise, said reports shall not be accepted as evidence in a pollution case);

WHEREAS, there is a need for respondent firms to periodically provide information to the Pollution Adjudication Board (PAB) that shall aid the Board in the resolution of pollution cases;

WHEREAS, there is likewise a need to continuously update the PAB database;

RESOLVED therefore as it is hereby resolved that effective 01 January 2001, all companies and Pollution Control Officer s of companies with PAB cases are directed to provide the PAB copies of monthly PCO reports in accordance with Annex C of DAO 26 Series of 1992, duly executed under oath and received by the Regional Office.  Be it resolved further that ALL Environmental Management Bureau (EMB) Regional Offices shall furnish the Board semi-annually, a list of the companies who have submitted PCO reports.
