GUIDELINES ON THE MANAGEMENT AND OPERATION OF TRUCKHOLDING AREA (THA) AT THE FORMER V & H MANUFACTURING AND A G & P AREAS EXPANDED PORT ZONE (EPZ) SOUTH HARBOR MANILA
1. AUTHORITY
1.1 Section 6a(x), PD 857, Revised Charter of PPA
1.2 Executive Order No. 321 dated 17 March 1088.
1.3 Letter of GM to ATI dated 08 July 1999 on Turnover of said areas to ATI
2. OBJECTIVES
2.1 To ensure the rational, optimal and equitable use of the said THA.
2.2 To regulate the entry on access of trucks into South Harbor Pier Areas via Gate 7 to deliver thereto or withdraw therefrom empty/loaded containers.
2.3 To enhance port operational efficiency thru the use of the THA as a complementary facility to the pier areas and the operating system of the South Harbor Container Terminal.
3. PURPOSES
3.1 To provide guidelines for the cargo handler in the management and operations of the THA and its availment by truckers.
3.2 To prescribe the conditions for the rational utilization by all concerned of the THA and the imposition of the reasonable sanctions for violations thereof.
3.3 To impose reasonable fees on truckers after the period for initial-free-of charge availment of the THA.
The Authority in coordination with the cargo handlers shall determine within three (3) months from the approval of this Circular the imposition of appropriate fees to be charged from the truckers as reasonable compensation for the use of the THA and to defray expenses for the repair and maintenance thereof.
4. GUIDELINES
4.1 Only trucks intending to withdraw from and/or deliver containerized cargoes to the pier at South Harbor via Gate 7 shall be allowed entry thereto if they are in possession of Permit to Operate (PTO) and truck stickers issued by the PMO-South Harbor ATI-EIR (Equipment Interchange Receipt) and Shipping Line Export Container Order (ECO).
4.2 Trucks without documentation as required in 4.1 may be allowed entry to the THA if slots are available for stay of not more than twelve (12) hours from 9 00 A.M. to 9:00 PM.
To avoid the use of the THA as an operation base by truckers to service cargoes outside of South Harbor their trucks shall be charged parking fee of One Hundred Pesos (P100.00) for the first two (2) hours and additional of Fifty Pesos (P50.00) per hour for succeeding hour when the trucks leave the THA before 5:00 P.M. However the trucks will not pay the parking fee when they leave the area after 5:00 P M . and truckers are unable to secure documents for the movement or servicing of cargoes inside the piers of South Harbor.
4.3 The entry to and hours of stay of trucks at the THA shall be monitored by the cargo handler thru the use of computer system and approved by PMO-South Harbor.
4.4 The driver/helpers of trucks permitted entry into the THA shall abide by the following rules:
4.4.1 Clean the slots occupied by them before leaving said areas.
4 4 2 Not dump garbage except in receptacles provided at proper places by cargo handler and neither use the THA as urinating place or disposal of human waste.
4.4.3 Not leave at any time trailer/chassis without prime mover and/or unattended by driver.
4.4 4 Not use the THA as a repair/ motorpool area or overnight parking.
4.4.5 Not use the THA for gambling, illegal drugs, drinking alcoholic beverages nor use the same for cooking.
5. ROLE OF CARGO HANDLER
5.1 Manage develop and operate the THA at no cost to PPA in accordance with this Circular and for this purpose to formulate and adopt detailed procedures necessary for the effective attainment of the objectives herein set forth.
5.2 Require truckers/drivers helpers strict compliance with the rules on the proper utilizations of the THA.
5.3 Coordinate with the Port Police Division and the Port Manager of PMO-South Harbor on the imposition of the administrative penalties for violations of this Circular.
5.4 Submit monthly report to the Port Manager regarding the operations of the THA, problems/issues encountered and the solutions/actions taken or recommended.
6. ROLE OF PMO-SOUTH HARBOR
6.1 Supervise the management and operations of the THA by the cargo handler, which supervision is defined generally to oversee and ensure that the THA is efficiently managed/operated, but without interference with the day to day activities thereat.
6 2 Extend assistance, thru the PPD, especially in the implementation of the penalty provisions of this Circular.
6.3 Resolve operational issues or concerns that may arise from the implementation/application of this Circular.
6.4 Implement related measures to ensure the effective implementation of this Circular.
7. ROLE OF TRUCKERS
7.1 Strictly abide by the rules on retrieval and use of the THA.
7.2 Coordinate with and assist the cargo handler in the cleanliness and maintenance thereof.
8. SANCTIONS
8.1. Truckers/drivers of trucks who are found to have violated any of the foregoing guidelines on the utilization of the THA shall be imposed a fine of:
8.1.1 P125.00 for first violation
8.1.2 P250.00 for second violation
8.1.3 P500.00 for three (3) consecutive violation within a quarter and the truck/vehicle involved subject to:
8.1.3.1 Ban in the use of the THA for three (3) months.
8.1.3.2 Transfer at owner's/driver's expense to authorized impounding area.8.2 The management and operations of the THA shall be withdrawn from the Cargo Handler if the objectives of this Circular are not attained or when the use of the THA by truckers/drivers has been abused in violations of this Circular.
9. CHANGE/MODIFICATION
In the course of its implementation, these Guidelines shall be subject to periodic review and necessary changes or modifications shall be affected by PMO-South Harbor after dialogue/consultation with Cargo Handler and concerned sectors of port users in order to make its implementation more reasonable/practicable and effective in achieving the objectives herein set forth.
10. REPEALING CLAUSE
PPA PDO-Manila and PMO-South Harbor issuances, rules or regulations inconsistent herewith are hereby repealed or amended accordingly.
11. EFFECTIVITY
This Circular shall take effect immediately after fifteen (15) days following its publication in a newspaper of general circulation.
