Pursuant to Section 54, Book IV of the Administrative Code of 1987 and Executive Order No. 159 (1994) as implemented by DOF-DBM Joint Circular No. 2-94, directing the Department of Trade and Industry, among others to revise its fees and charges at just and reasonable rates sufficient to recover the full cost of services rendered, the following rules are hereby prescribed and promulgated for the information, guidance and compliance of all concerned:

1.         Scope - This Department Administrative Order covers fees relative to the conduct of complete or partial product testing and inspection in accordance with established procedures in connection with, but not limited to, the implementation of the product Certificate Scheme (PS-ICC Marks) of the Bureau of Product Standards. This Order does not include the testing fees charged by other laboratories utilized by BPS for its product certification program.

2.         Revised Schedule of Product Testing Fees - The revised schedule of testing fees of BPS Testing Center is provided in Annex "A" hereof.

3.         Extent of Tests and Inspection - The tests and/or inspections covered by the listed testing fees are based on the present capabilities of the BPS Testing Center (hereinafter referred to as BPSTC).

4.         Fees for New Work - BPS shall calculate fees for the conduct of new work not currently covered by this Order to recover the full cost of the services rendered. Costing shall include cost of manpower, equipment, power consumption and other utilities, environment, equipment maintenance and depreciation, consumable and other incidental costs relative to the performance of required test/s. The fees for new work shall be prescribed by Department Administrative Order.

5.         Adjustments of Testing Fee due to Additional or Reduced Tests - If additional tests are deemed necessary to further evaluate the product, BPS shall charge additional test fee/s corresponding to the particular test/s conducted. Likewise, should BPS deem said tests are not necessary/not applicable to the product, the test fee corresponding to the test/s not conducted/not applicable to the product shall be considered as "excess/undue payment" to be refunded as provided in the following Section.

6.         Excess/Undue Payments - Excess/Undue payments for any of the fees covered by this Order, shall be refunded to the payer by way of crediting the excess/undue payments to future financial obligations of the payer to the BPSTC.

7.         Repealing Clause - All Orders, Rules and Regulations, or parts thereof, inconsistent with this Order are hereby repealed or amended accordingly.

8.         Effectivity -This Order shall take effect fifteen (15) days after publication in two (2) newspapers of general circulation.
