WHEREAS, RA 4136 otherwise known as the "Land Transportation and Traffic Code" prohibits any person and/or passenger from hitching, hanging on to or riding on the outside or the rear end of any vehicle and for any driver to knowingly permit any person/passenger to hang on to or ride on the outside or rear end of his vehicle;

WHEREAS, RA 7924 empowers the MMDA to enforce all traffic laws and regulations in Metro Manila through the Traffic Operations Center; to issue rules and regulations and to fix and impose fines and penalties for all kinds of violations of traffic rules and regulations;

WHEREAS, several vehicles are seen with persons/passengers hanging on to/ riding outside or the rear end of said vehicle; in utter disregard of the aforesaid provisions of RA 4136;

WHEREAS, the said practice poses grave danger to the life and limb not only of the riding public but also to the motorists as well;

WHEREAS, in order to promote public safety and prevent the occurrence of road accidents which often cause traffic, the Metro Manila Council deemed it imperative to strictly implement the aforementioned provision of RA 4136 and impose penalty for violation thereof.

NOW, THEREFORE, pursuant to Section 6 of RA 7924, this Regulation is hereby adopted and promulgated by the Metro Manila Council, that:

Section 1. Coverage. This Regulation shall apply to all types of vehicles plying along the thoroughfares of Metro Manila.

Section 2. Definition of Terms. For purposes of this Regulation, the following terms or words shall mean or be understood as follows:

a. Hitching - means holding on to/holding fast to a moving vehicle while riding on a bicycle, roller skate, skateboard or other similar device.

b. Hanging on to or riding on the outside or the rear end of a vehicle - means standing or sitting on the stirrup (estribo) or running board of a vehicle while in motion.

Section 3. Prohibited Acts

1. It is unlawful for any person or passenger to hang on to/ride on the outside or at the rear end of a motor vehicle.

2. It is unlawful for any driver to allow/permit any person/passenger to hang on to or ride on the outside or at the rear end of a motor vehicle.

3. It is unlawful for any driver to allow/permit any person riding on a bicycle, roller skate, skateboard and other similar device to hold on to/or hold fast to (hitch) a moving vehicle.

Section 4. Penalty

The following shall be imposed to violators of this Regulation:

P500.00 - for the driver
P150.00 - for the passenger
P150.00 - for the hitcher

Section 5. Effectivity. This Regulation shall take effect fifteen (15) days after publication in two (2) newspapers of general circulation in Metro Manila.
