AMENDING MMA ORDINANCE NO. 1, SERIES OF 1994 AND MMDA ORDINANCE NO. 5, SERIES OF 1995, RE MMA FINANCIAL ASSISTANCE TO GOVERNMENT TRAFFIC ENFORCEMENT UNITS IN METRO MANILA



WHEREAS, Section 1 of MMA Ordinance No. 1, s. 1994, provides that twenty five (25%) of the total fines collected intended as financial assistance shall be disbursed through the Traffic Enforcement Units concerned;

WHEREAS, Section 4 of MMDA Ordinance No. 5, s. 1995, provides that the Local Government Units shall also receive twenty five (25%) percent financial assistance out of traffic fines collected for violations committed in their respective localities as funds for the LGUs for the maintenance and operations of traffic management in their respective jurisdictions;

WHEREAS, there is a need to distribute the financial incentives directly to the Traffic Enforcers, and to adjust their share to 10%;

WHEREAS, the General Appropriations Act of FY 1998 provides;
"3) Authority to Use Fines, Fees and Charges - "Pursuant to Section 10 of RA 7924, the Metropolitan Manila Development Authority is hereby authorized to use its proceeds from fines, fees and charges which it may impose and collect, as well as the mandatory remittances of its component local government units, to implement such programs, projects and activities as may be approved by the Metropolitan Manila Development Council."
NOW, THEREFORE, be, it resolved, as it is hereby resolved, that the Council hereby further amends Section 1 of Ordinance No. 1, s. 1994 and Section 4 of MMDA Ordinance No. 5, s. 1995, to read as follows:
"SECTION 1. Manner of Disbursement and Distribution - the 15% of the total fines collected intended as financial assistance to Traffic Enforcers and Traffic Enforcement Units concerned shall be distributed as follows:

a. Ten (10%) percent shall be given to the Enforcers concerned to be disbursed through Automated Teller Machine (ATM); and,

b. Five (5%) percent shall be released to Traffic Enforcement Units as Funds for office maintenance and operating expenses in accordance with COA Rules and Regulations."

"SECTION 4.Local Government Units shall also receive ten (10%) percent financial assistance out of traffic fines collected for violations committed in their respective localities as funds for the LGUs for the maintenance and operation of traffic management in their respective jurisdiction.
This Regulation shall take effect upon approval.
