UPDATED LIST OF FOREIGN COUNTRIES GRANTED EXEMPTION FROM PORT CHARGES



1. AUTHORITY

a. Section 21, P.D. No. 857 dated 23 December 1975, as amended

b. PPA Memorandum Circular No. 07-94 dated 09 March 1994

c. PPA Memorandum Circular No. 03-95 dated 05 January 1995

d. PPA Memorandum Circular. No. 08-97 dated February 5, 1997

2. GENERAL

PPA Memorandum Circular No. 08-97 prescribes the policies and procedures for exemptions of state vessels of foreign countries from payment of port charges.

This Memorandum Circular contains the updated list of foreign countries so exempted as of this date. Unless otherwise indicated herein, all vessels concerned shall be charged usual port charges.

3. OBJECTIVES

a. To ensure reciprocal privileges to naval and state vessels owned by the Philippine government which are similarly situated as foreign vessels granted port charges exemption by the Authority.

b. To facilitate the grant of port charges exemption to foreign-owned naval and state vessels whose governments grant similar exemption to vessels owned by the Philippine government.

4. Vessels of these countries shall be granted reciprocal port charges exemption in accordance with the following categories:
a. Countries which grant exemption to state vessels:

Australia, Bangladesh, Canada, Fiji, People's Republic of China and Hong Kong, Lebanon, Republic of Korea, Thailand, Argentina, Hellenic Republic (Greece), Paraguay, Peru and Gambia.

State or naval vessels of the countries concerned shall be allowed exemption from vessel charges in any government port managed and administered by the Philippine Ports Authority.

b. Countries which grant exemption to state, and naval vessels or warships at naval facilities or military ports only.

Malaysia and United Kingdom of Great Britain

State and naval vessels or warships of the countries concerned shall not be allowed exemption from vessel charges in any government port managed and administered by the Philippine Ports Authority.

c. Countries which grant exemption to naval vessels or warships in commercial ports

Kenya and Mauritius

Warships or naval vessels owned by the countries concerned shall be exempted from vessel charges in any government port under the administration of the Authority.
5. REPEALING CLAUSE - All PPA issuances, inconsistent herewith are hereby amended/modified/revised accordingly.

6. This Memorandum Circular shall take effect immediately.
