[ SRA SUGAR ORDER NO. 7, s. 2006-2007, January 25, 2007 ]
VERIFICATION OF A OR U.S. QUOTA SUGAR WITH UNDERTAKING TO SHIP TO THE U.S.
WHEREAS, the Philippines has been granted a Tariff Rate Quota (TRQ) of 167, 174 MTCW (OR 173.025 MTRV) by the United States for Quota Year (QY) 2006-2007 and it is in the long term national interest of the Philippines and the sugar industry to fill up the said U.S. Quota;
WHEREAS, only 19,276.65 of A quedans had been verified by the Sugar Regulatory Administration out of the total quantity of 89,815 of verifiable/outstanding A quedans (of Crop Year 2006-2007) eligible for export as of week-ending January 14, 2007;
WHEREAS to facilitate the filling up of the U.S. quota in the past, when necessary, the SRA had put in verification deadlines for the A quedans;
WHEREAS records show that in the past, while there had been substantial compliance to verification of A quedans for shipment to the United States, a significant volume of the verified A or U.S. quota sugar was not actually shipped out;
WHEREAS there is a need to ensure that the full quota is actually shipped to the United States after the verification of A quedans has been accomplished;
WHEREAS the Sugar Alliance of the Philippines, in its letter dated 12 January 2007, has recommended to SRA to issue a Sugar Order that will set up guidelines for the verification of the A quedans as produced in order to ensure the timely shipment of the sugar to the U.S. market.
NOW, THEREFORE, under and by virtue of the authority vested in the Sugar Regulatory Administration (SRA), it is hereby ordered that:
SECTION 1. Deadline of Submission for Verification of A Quedans for the U.S. Quota
SECTION 2. No Advance Swapping of A Export Sugar into B Domestic Sugar
It is hereby reiterated the pronouncement of the SRA through its Circular Letter No. 21 dated February 23, 2006, that the SRA will not adopt a policy of Advance Swapping of the A export sugar into B domestic sugar for the current CY 2006-2007, to ensure the filling up of our U.S. quota for QY 2006-2007.
SECTION 3. Provisions of Sugar Orders, Circular Letters and/or other regulations contrary to or inconsistent with this Sugar Order are hereby amended, modified, or revoked accordingly.
SECTION 4. This Order shall take effect immediately.

In order to ensure the filling up of the U.S. quota at the appropriate time, hereunder is the scheduled deadline of submission of A quedans of CY 2006-2007 to the PCRO, SRA, Quezon City for verification: | ||

The subject A quedans if not verified with the SRA on or prior to the above-mentioned deadline/s shall be classified as HOMELESS quedans and its covering sugar is a non-status or non-marketable sugar which cannot be withdrawn from the mills. |

c) | An Undertaking to Ship A Sugar to the United States shall be signed by the trader/exporter indicating his commitment to ship the A sugar on or before the schedule as agreed upon by the SRA and to comply with all the terms and conditions therein set forth, shall be a part of the verification requirements. |

d) | A circular letter defining the details of the above-mentioned Undertaking to Ship Out A Sugar to the United States shall be issued as soon as possible. |
SECTION 2. No Advance Swapping of A Export Sugar into B Domestic Sugar
