PROVIDING INTERIM ARRANGEMENT IN THE IMPLEMENTATION OF APPROVED EDUCATION AND TRAINING UNDER PARAGRAPH 2.5 OF REGULATION II/1 OF THE 1978 STCW CONVENTION, AS AMENDED



WHEREAS, paragraph 2.5 of Regulation II/1 of the Convention provides that every candidate for certification as officer-in-charge of a navigational watch on ships of 500 gross tonnage or more shall have completed approved education and training and meet the standard of competence specified in Section A-II/1 of the STCW Code;

WHEREAS, the approved education and training required under the above-mentioned provision of the Convention is the four-year course in Bachelor of Science in Marine Transportation (BSMT) issued by the Commission on Higher Education which commenced on 01 June 1998;

WHEREAS, before the commencement of the BSMT course on 01 June 1998, a large number of Cadets have been enrolled and graduated in the marine transportation course prescribed in accordance with the provisions of the Convention which apply prior to 01 February 1997.

WHEREAS, in the spirit of equity and fairness, in conformity with Article IX of the Convention, those who have been enrolled and graduated in the prescribed course before 01 June 1998 should be given a chance to qualify under the 1978 STCW as amended, provided that the candidate undertakes the additional training required.

NOW, THEREFORE, in consideration of the above premises and in accordance with the authority of the Maritime Training Council under Section 1 of Executive Order No. 242 dated 12 May 2000 hereby directs the Professional Regulation Commission to establish the appropriate interim arrangement to comply with Paragraph 2.5 of Regulations II/1 which shall enable candidates to qualify for certification under such Regulation taking into account the relevant provisions of Article IX of the 1978 STCW Convention, as amended.

PROVIDED that after 01 February 2004, this interim arrangement shall cease to apply and only those who have complied with the education and training which commenced 01 June 1998 shall be considered.
