This is to reiterate the exclusive power of this Board to issue provisional authority, which was solely vested by virtue of Executive Order 202 and by Commonwealth Act 146, as Amended.

Thus, this Board hereby directs all Regional Directors of this Board including Cordillera Administrative Region (CAR), Autonomous Region of Muslim Mindanao (ARMM), and CARAGA to immediately CEASE & DESIST from issuing PROVISIONAL AUTHORITY to Operate Public Land Transportation Services except in the following cases:

1. Provisional Authority to Operate Truck for Hire Services in all their respective regions.

2. Provisional Authority to Operate Tourist Transport Service in Palawan by Regional Office IV;

All Petitions for Provisional Authority filed within the Regional Offices of this Board not covered by the exception as above-cited should be properly endorsed with the LTFRB Central Office for the approval of the Board En Banc.

In relation thereto, Memorandum Circular 2006-062 authorizing Regional Directors the issuance of Provisional Authority to Operate GT (P2P) Express Service is likewise RECALLED.

All issuances inconsistent herewith are hereby superseded and amended accordingly. This Memorandum Circular shall take effect immediately.
