[ CSC MEMORANDUM CIRCULAR NO. 29, July 16, 1992 ]

AUTHORIZING THE FILLING UP OF CERTAIN POSITIONS WITHOUT THE NEED OF PRIOR APPROVAL OR AUTHORIZATION FROM THE COMMISSION



Pursuant to CSC Resolution No. 92-892 dated July 16, 1992, the Civil Service Commission hereby adopts the following policies authorizing the filling up of certain positions in government offices without the need of prior approval or authorization from the Commission:

1. Filling up of vacant positions in an agency by promotion of existing employees in the said agency is exempted from the prohibition imposed by RA 7430 and shall not require prior authorization from the Commission.

2. Casual, contractual and temporary employees of the government are "existing employees" and the renewal of their appointment does not involve the filling up of vacant positions, hence, renewal of their appointment is exempted from the prohibition imposed by RA 7430 and shall not require prior authorization from the Commission.

3. Positions of doctors and nurses in government hospitals, clinic and puericulture centers are not only vital and necessary but also difficult to fill, hence, the filling up of vacancy in said positions is exempted from the prohibition imposed by RA 7430 and shall not require prior authorization from the Commission;

4. Positions of Attorney in agencies performing primarily quasi-judicial functions are vital and necessary to the continued and effective operation of said agencies, hence, the filling up of vacancy in said positions is exempted from the prohibition imposed by RA 7430 and shall not require prior authorization from the Commission; and

5. Personal or confidential staff in the offices of Department Secretaries and other officials of Cabinet rank or Chairman and members of Commissions are vital and necessary to the continued and efficient operation of said offices, hence, the filling up of vacancy in said positions is exempted from the prohibition of RA 7430 and shall not require prior authorization from the Commission.

This Memorandum Circular takes effect immediately.
