DEFINING MINOR ERRORS IN ENTRIES ON THE BIRTH CERTIFICATES AND TRANSCRIPT OF RECORDS THAT SHALL BE ACCEPTABLE AND SHALL NOT BE CONSIDERED AS DEFERRED CASES



WHEREAS, the Commission issued Resolution No.2002-27 dated January 18, 2002 requiring applicants for licensure examinations to submit complete documentary requirements and with correct or consistent entries as to name, date of birth and gender to ensure the integrity of birth data and in order not to saddle personnel of the Commission attending to applicants with more work in lifting the deferment of those accepted with discrepancies in documents and entries, and also in view of tens of thousands of unclaimed deferred results that could render identities vulnerable to those who might profit thereby.

WHEREAS, as a rule stated in the said Resolution applications whose entries with respect to name, date of birth and sex differ from the entries in the birth certificate and the transcript of records and other required documents shall not be accepted.

WHEREAS, in order not to unduly penalize applicants who, through no fault of their own have errors on the entries of data in the transcript of records and birth certificates, there is a need to balance the pursuit of integrity with fairness to applicants by classifying errors in documents into major and minor errors. Minor errors will be acceptable for purposes of application. Major errors because of legal implications will, however, still not be acceptable.

WHEREAS, those identified as major errors are the following:

    1. Discrepancy in the surname/last name and given name/first name, such as "Amelia" and "Susan"; "Reyes" and "Perez"'; "Baby Boy"; "Baby Girl";

    2. Discrepancy in the date of birth

WHEREAS, those identified as minor errors are the following:

    1. Inconsistencies in the usual writing or printing of names of persons such as:

      a. "MA" and ˜MARIA"; "JR" and `JUNIOR", and the like
      b. "SIS", "SISTER" AND "SOR"
      c. "DE LA" and "DELA", DE LOS" and "DELOS", and the like
      d. "MARYJANE" and "MARY JANE" and the like
      e. Names with or without hyphen

    2. Wrong gender, "Male" instead of "Female" and vice-versa

    3. No gender printed on the birth certificate

    4. Discrepancies in vowels/double and single letters in the spelling of first, middle and last name, such as ˜RAYMUNDO-REYMUNDO", "MUNDA-MUNDO-MONDO", BARRAMEDA-BARAMEDA", and the like

WHEREFORE, the Commission RESOLVED as it hereby RESOLVES to direct officials and employees of the Commission assigned in the Application Division/Units/Sections in the Central and Regional Offices to do the following:

    1. Those identified as major errors shall NOT be accepted unless the entries are corrected, thereby maintaining the "no deferred" policy.

    2. Those identified as minor errors in the usual writing or printing of names, with or without hyphen, whole or separate names, whole or abbreviated traditional names, discrepancies in vowels/double and single letters in the names shall be accepted, provided an affidavit of discrepancy shall be executed and submitted. The name in which the applicant is customarily known shall be followed.

    3. Those with wrong gender or without gender printed on the birth certificate shall be accepted provided all of the following shall be presented and submitted: (a) baptismal certificate from the parish, (b) parent's or guardian's affidavit, and (c) certification from the barangay chairman or his representative proving that the applicant is really a male or female.

This Resolution shall take effect upon its approval.

Let copies of this Resolution be published in the Official Gazette and newspaper of general circulation and furnished the UP Law Center, the Commission on Higher Education (CHED), all schools, colleges and universities offering courses for licensure examinations.
