[ POEA MEMORANDUM CIRCULAR NO. 64 S. 1992, July 16, 1992 ]

ADDITIONAL GUIDELINES FOR TAIWAN



Further to Memorandum Circulars No. 24 and 43, Series of 1992, regarding Guidelines for Taiwan, the following additional guidelines for Taiwan are hereby issued:

SECTION 1. Advertisement

a. All requests for advertisement submitted to POEA by the co-agent must be co-endorsed by its lead agent. Manpower pooling by lead or co-agents shall not be allowed.

Advertisements for actual job vacancies by lead and co-agents for their accredited Taiwanese principals/projects shall be subject to the approval of the Administration. Approval shall be granted upon submission of a certificate copy of the approved job order, and provided further that the following basic information are indicated in said advertisement:
  1. name and address of the agency
  2. accreditation number of the project and/or principal and worksite
  3.  actual number of skill categories and qualification standards
  4. documentary requirements for the applicants
b. All agencies authorized to recruit for Taiwan, regardless of type of license, may advertise and recruit any skill category required by the Taiwanese employers, subject to the requirement of Section 1.

SECTION 2. Medical Examination - To facilitate the documentation of Taiwan-bound workers ready for visa issuance, the Taiwan Department of Health and the Philippine Department of Labor and Employment (DOLE) in coordination with the Philippine Department of Health (DOH), have granted approval for the following hospitals to service the medical requirements of workers bound for Taiwan, as an interim arrangement:
Makati Medical Center
Manila Doctors Hospital
Medical Center of Manila
SECTION 3. Minimum Wage - Wages for Taiwan shall no be less than NT$12,720 per month effective 01 August 1992 for official minimum wage policy of the Taiwan government.

SECTION 4. On Hiring of Filipino Fishermen - Upon recommendation of the Philippine Labor Center in Taipei and pending the release Taiwan's Council of Labor Affairs (CLA) of the implementing guidelines on the hiring of foreign fishermen, the accreditation of Taiwan principals hiring Filipino fishermen is temporarily suspended.

SECTION 5. On Hiring of Personal Caretakers and Domestic Helpers - The entry of foreign personal caretakers and domestic helpers to Taiwan is now allowed by the Taiwan government. Personal caretakers are workers assigned to the caring of invalid dependents or disabled while domestic helpers are assigned to take care of the daily lives of families:

a. No name hiring of personal caretakers and domestic helpers shall be allowed for Taiwan.

b. Following release of Taiwan's is implementing rules and guidelines on personal caretakers, the following documents shall be required for the accreditation of employers hiring personal caretakers:
  1. Special Power of Attorney verified by the Philippine Labor Center (PLC) in Taiwan and authenticated by the MECO;

  2. Approval letter of the Council of Labor Affairs, (translated in English), authenticated by the Ministry of Foreign Affairs, Taipei and verified by the PLC;

  3. Household registration, translated in English, authenticated, by the Ministry of Foreign Affairs, Taipei, and copy of Employer's ROC I.D. verified by the PLC;

  4. Job orders verified by the PLC; and

  5. Individual Contract of Employment verified by the PLC.
c. Regular processing requirements for Taiwan shall apply to personal caretakers.

d. Documentary requirements for accreditation and processing of domestic helpers for Taiwan shall be issued upon release of the implementing rules and guidelines on the same by Taiwan's Council of Labor Affairs.

This circular shall take effect immediately.
