[ SRA SUGAR ORDER NO. 10, July 24, 1996 ]

AUTHORIZING THE GRADUAL RECLASSIFICATION OF IMPORTED SUGAR FROM "C" OR RESERVE SUGAR INTO "B" OR DOMESTIC SUGAR



WHEREAS, the Sugar Regulatory Administration (SRA) in the exercise of its regulatory functions has classified all sugar importations as "C" or Reserve sugar since 22 February 1996;

WHEREAS, the SRA has deemed it necessary and appropriate to gradually or partially reclassify the aforementioned imported sugar from "C" or Reserve sugar into "B" or Domestic sugar in order to prevent or minimize the losses, if ever, of the importers concerned, due to the cost of storing or keeping the imported sugar a period of time.

NOW, THEREFORE, under and by virtue of the authority vested in the Sugar Regulatory Administration, it is hereby ordered that:

SECTION 1. The SRA shall re-classify or convert a total of 50,000 M.T. of imported sugar from "C" or Reserve sugar into "B" or Domestic sugar every month, starting July, 1996 and thereafter, when deemed necessary;

SECTION 2. The priority of re-classification of the imported sugar from "C" to "B" shall be determined by the SRA based on : i) importers/consignees found not violating existing Sugar Order and Circular Letter on sugar importations, and (ii) a First In-First Out principle, which is to reckon with the dates of the SRA clearance issued to importers/consignees.

SECTION 3. The SRA shall notify the importers/ consignees concerned that their imported sugar has been re-classified as "B" or Domestic sugar.

SECTION 4. This Sugar Order shall take effect immediately.

SECTION 5. Provisions of Sugar Orders, Circular Letters, rules and regulations inconsistent with or contrary to this Sugar Order are hereby revoked, amended or modified accordingly.
