[ CIAC RESOLUTION NO. 05-98, October 08, 1998 ]
AUTHORIZING THE CIAC EXECUTIVE DIRECTOR OR ITS OFFICER-IN-CHARGE TO ACT ON MOTIONS FOR TIME EXTENSION
WHEREAS, Executive Order No. 1008 mandates the expeditious settlement of construction disputes filed with the Construction Industry Arbitration Commission (CIAC);
WHEREAS, Sections 6 and 21 of Executive Order No. 1008 empower the Construction Industry Arbitration Commission (CIAC) "to enunciate policies and prescribe rules and procedures for construction arbitration" and "to formulate and adopt necessary rules and procedures for construction arbitration" to achieve this end;
WHEREAS, there are a lot of instances where there is a need for the Commission to act on motions filed by the parties before the appointment of arbitrator/s in a case;
WHEREAS, such motions pertain to administrative matters specifically requests for time extension of the period within which to submit pleadings;
WHEREAS, requests for such nature requires prompt action by the CIAC;
NOW, THEREFORE, BE IT RESOLVED, AS IT HEREBY RESOLVED, that the Executive Director of the Commission or its Officer-in-Charge be authorized to act on motions for time extension for cases where the arbitrator/s have not yet been appointed; PROVIDED that motions to dismiss, challenge or inhibition shall continue to be referred to the Commission for appropriate action.
