[ NTC MEMORANDUM CIRCULAR NO. 02-02-2004, February 12, 2004 ]

OCULAR INSPECTIONS OF ALL RADIO STATIONS OPERATED BY PUBLIC TELECOMMUNICATIONS ENTITIES (PTE)



Pursuant to Act No. 3846, as amended (Radio Control Law), RA7925 (Public Telecommunications Policy Act), EO546 series of 1979 and in order to ensure that all radio stations are operating within the limits of the radio station licenses to prevent harmful interference, the following guidelines in the conduct of inspections are hereby promulgated.

  1. Inspections shall be conducted only by personnel of the National Telecommunications Commission (Commission) with valid Mission Order signed by any of the Regional Directors or by any of the Commissioner and Deputy Commissioners.  The Commission may seek the assistance of the law enforcement agencies as they deem necessary; provided, that in the conduct of the inspection, an NTC representative shall always be present.

  2. The public telecommunications entities (PTE) operating radio stations including cell base stations and links are directed to allow personnel of the Commission with valid Mission order to conduct ocular and physical inspections on the radio stations, cell base stations and links.

  3. The Regional Directors are directed to strictly observe their geographical areas of responsibilities and shall submit written report of inspection to the Commissioner not later than five (5) working days from the date of inspection.

  4. Any person or public telecommunications entity found violating this memorandum circular shall be dealt with in accordance with law.

  5. This memorandum circular shall take effect fifteen (15) days after publication in a newspaper of general circulation and three (3) certified true copies furnished the UP Law Center.
